During an investigation, it was determined that on June 23, 2025, center staff failed to provide watchful oversight when a 6-year-old child with a documented allergy to nuts ate candy containing peanuts that was provided by another child. At approximately 4 p.m., children in the classroom were consuming candy that the older children obtained on a field trip earlier in the day. At approximately 5 p.m., the child with the allergy informed a staff member that they were experiencing stomach pains and then vomited twice. The child was picked up at 6:30 p.m. At home, the parent noticed that the child had hives and facial swelling. The child received professional medical attention and was diagnosed with an allergic reaction.

At home, the parent noticed that the child had developed hives and facial swelling and took the child for professional medical attention. The allergy was indicated on the child’s enrollment form; however, center staff were unaware of the child’s allergy until after the incident occurred. In addition, the center did not have a written statement from a medical authority on file as required.

The child was diagnosed with an allergic reaction to peanuts.

During a Complaint Closure conducted on April 15, 2024, it was determined based on an investigation, that on February 15, 2024, staff members failed to provide watchful oversight when a five-year-old child was able to stand on the edge of the jungle gym double slide play structure, near the back fence, and jump off the play structure landing on their right arm. Staff members were not positioned to observe all the children in their care to prevent harm or injury and the staff were not aware of the child’s actions. Professional medical attention was obtained, where the child was treated for the sustained injuries.

During an Incident Investigation Closure conducted on September 19, 2023, it was determined based on an investigation that on July 19, 2023, a three-year-old was not properly supervised when the child fell from a play structure on the playground and sustained an injury to their arm. Staff responsible for the child were unaware the child had fallen from the structure, and were unaware of the injury until the child reported it to the teacher. The child received professional medical attention. An adverse action was previously issued for this rule violation. This rule violation is no longer appealable. No fine is being issued at this time.

During an investigation, it was determined that on July 19, 2023, at approximately 4:20 p.m., watchful oversight was not provided when a three-year-old child sustained a broken elbow on the playground after falling from a play structure. There were three staff and 31 children on the playground. The staff reported they were stationed in different areas of the playground to supervise the children. None of the staff witnessed the child’s fall, and the staff were unaware of the child’s injury until the child reported the injury to one of the teachers. The teacher took the child inside and reported the injury to the administrator. After observing an obvious injury to the child’s arm, an ice pack was applied to the child’s arm and the injury was reported to child’s parent. The three-year- old child was taken to the hospital for professional medical attention.

Additionally, the staff did not provide adequate supervisions in that the staff were unaware that the child fell from the monkey bars. The child received professional medical treatment and was diagnosed with a broken arm.
