    591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm¶s length away from children thirty- six (36) months of age and younger.

    During an Incident Investigation Closure conducted on May 15, 2023 ; It was determined that on March 27, 2023, at approximately 4:25 p.m., a three-year-old child sustained an injury to the left ring finger when a classroom door that leads to the playground closed on the child's finger. Staff were unaware that the child was near the door or that their finger was in the door. An adverse action was previously issued for this rule violation. This rule violation is no longer appealable. No fine is being issued at this time.

    During a Complaint Closure conducted on September 20, 2023 ; It was determined based on investigative findings that on August 24, 2023, watchful oversight was not provided to a three-year-old child who had approximately nine braids cut out of their hair by another child, and staff was not aware that the incident had occurred.     591-1-1-.15(9) · Rule 591-1-1-.15(9) requires that a written statement be on file from a medical authority when a child requires a modified diet for medical reasons and from the child's Parent(s) when a child requires a modified diet for religious reasons. All caregiver Personnel shall be informed of the diet restriction for the child and only food that complies with the prescribed dietary regimen but still meets the food and nutrition requirements shall be served to the child.

    During an investigation, it was determined that the center self-reported that on November 18, 2022, at approximately 8:30 a.m., a two-year-old child with a known allergy to oats and Cheerios was served Cheerios cereal during breakfast. Staff persons stated that the two-year-old child's name and allergy to oats were posted in the classroom, but when the child was served the cereal, staff did not think about the child's allergy. The child's enrollment application also documented specifically "no Cheerios" and that the child was allergic to oats. Professional medical attention was obtained.
