    591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm¶s length away from children thirty- six (36) months of age and younger.

    During an Incident Investigation Closure conducted on April 4, 2025 ; It was determined based on an investigation that on February 26, 2025, center staff did not provide watchful oversight and did not respond promptly to the actions of the children, when a two-year-old child was playing with the bathroom door and their right middle finger was closed in the door. Professional medical was obtained.

    During a Complaint Closure conducted on April 21, 2025 ; It was determined based on investigative findings that on April 2, 2025, center staff walked away and did not immediately respond when a three- year-old child climbed up on and was jumping up and down on a two and a half foot high shelf. The staff member was terminated from the center. No injuries were reported. Exhibit "A"

    During an investigation, it was determined that on February 26, 2025, eleven children were transitioning from the playground back into the classroom when a two-year-old child’s finger was shut in the bathroom door of the classroom. One child went into the bathroom and another child followed them in and that is when the incident occurred. The staff were unaware the incident occurred until the child cried out, due to assisting other children at the sink during handwashing. Professional medical attention was required.

    591-1-1-.32(1) · Rule 591-1-1-.32(1) requires that a center must establish groupings of children for care and maintain staff: child ratios as follows: Ages of Children Staff: Child Ratio* Maximum Group Size** Infants less than one (1) year old or children under eighteen (18) months who are not walking 1:6 12 One (1) year olds who are walking 1:8 16 Two (2) year olds 1:10 20 Three (3) year olds 1:15 30 Four (4) year olds 1:18 36 Five (5) year olds 1:20 40 Six (6) years and older 1:25 50 * Staff, such as the director or service workers (food, maintenance and clerical staff, etc.), shall be counted in the staff: child ratio only during the time that they are giving full attention to the direct supervision of the children. Service staff routinely acting as child care workers shall meet the qualifications of the respective caregivers. ** Maximum group size does not apply to outdoor play on the playground routinely used by the center or for special activities in the center lasting no more than two (2) hours. However, required staff: child ratios must be maintained.

    During an investigation, it was determined that on February 26, 2025, one staff member was caring for eleven two- year-old children, alone, when two staff members were needed. At the time of not meeting the child staff ratio requirements, a two-year-old child sustained a serious injury to the finger.

    591-1-1-.11(2) · Rule 591-1-1-.11(2) requires that Personnel not: physically or sexually abuse a child or engage or permit others to engage in sexually overt conduct in the presence of any child enrolled in the Center; inflict corporal/physical punishment upon a child; shake, jerk, pinch or handle a child roughly; verbally abuse or humiliate a child which includes, but is not limited to, the use of threats, profanity or belittling remarks about a child or his family; isolate a child in a dark room, closet or unsupervised area; use mechanical or physical restraints or devices to discipline children; use medication to discipline or control children's behavior without written medical authorization issued by a licensed professional and given with the parent's written consent; restrict unreasonably a child from going to the bathroom; punish toileting accidents; force-feed a child or withhold feeding a child regularly scheduled meals and/or snacks; force or withhold naps; allow children to discipline or humiliate other children; or confine a child for disciplinary purposes to a swing, highchair, infant carrier, walker or jump seat.

    During a Complaint Closure conducted on April 16, 2025 ; It was determined based on investigative findings that on December 12, 2024, center staff restrained a two-year-old child who had been getting up from their seat at the classroom table by placing a foot against the back leg of the child's chair and preventing the child from getting up again. Video footage showed that the staff member had their foot against child's chair for at least 37 seconds and the child attempted to push the chair back and was unable to move it far enough for them to get up from the chair.
