    591-1-1-.03(9) · Rule 591-1-1-.03(9) requires center staff to refrain from engaging in, or allowing children or other adults to engage in, activities that could be detrimental to a child's health or well-being, such as but not limited to, horse play, rough play, wrestling, and picking up a child in a manner that could cause injury.

    During an investigation, it was determined that on August 27, 2025, at approximately 6:00 p.m., three center staff engaged in a physical altercation in the school cafeteria in the presence of nine enrolled children. Two staff members were present in the cafeteria when a third staff member entered the room and began a verbal altercation. Multiple staff members entered the room and attempted to end the altercation; however, the altercation continued to escalate and the three staff members began to physically fight. During the incident, some of the children were removed from the room. However, other children were not able to be immediately removed due to the fighting and were struck by tables as the group of staff members continued to engage in the physical altercation. Center administrators contacted law enforcement and the three staff members were arrested and charged as a result of the incident.

    During an investigation, it was determined that on October 4, 2021, center staff allowed two one-year-old children to run in the classroom which resulted in the child hitting their head on a broken edge of a table. The child sustained a cut on their forehead. The staff member verbally redirected the children but did not physically intervene to ensure their safety before turning away from the children to attend to another task. Professional medical attention was obtained and the child received five stitches.

    During an investigation, it was determined that on October 4, 2021 there were multiple tables with broken and jagged edges in the toddler classroom. As a result, a one-year-old child hit their head on a classroom table and sustained a cut on their forehead that required professional medical attention.
