    591-1-1-.03(9) · Rule 591-1-1-.03(9) requires that staff shall not engage in, or allow children or other adults to engage in, activities that could be detrimental to a child’s health or well-being, such as but not limited to, horse play, rough play, wrestling, and picking up a child in a manner that could cause injury.

    During an investigation, it was determined that on July 29, 2024, an eight-year-old child sustained a chipped tooth and busted lip, when other children were playing inappropriately with a plastic bowling set. Children were using the bowling pins as a golf club when a bowling pin popped up and hit the eight-year-old child in the mouth. The staff person observed the children using the bowling set in the incorrect manner but did not intervene to correct the children’s actions. The eight-year-old child required professional medical attention.

Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the childcare area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty- six (36) months of age and younger.

    During a complaint closure on September 21, 2023, it was determined that on June 12, 2023, at 12:25 p.m., a three-year-old child swallowed a ring and staff was not aware that the incident occurred. There was one staff member and 13 three-year-old children. The three-year-old child was known for bringing small objects with them daily to the program. Staff were unaware that the child brought a small ring and during naptime the staff were cleaning the room the child reported they swallowed a ring. At the time of the incident the three-year-old child was laying on their cot when they swallowed the ring and began to cry. The child received professional medical attention.

The center called emergency services to assist with removing the two-year-old child’s right hand from the door. The two-year-old child was taken to the emergency room for treatment of an injured hand.
