    591-1-1-.12(1) · Rule 591-1-1-.12(1) requires each Employee and child in attendance to use all indoor and outdoor furniture, activity materials, and equipment in a safe and appropriate manner and in accordance with the manufacturer's instructions, recommendations, and intended use. All equipment and furniture shall be used only by the age-appropriate group of children.

    During an investigation, it was determined that on February 23, 2026, at approximately 5:08 p.m., center staff allowed 2-year-old children to play with large wooden hollow blocks that were not age-appropriate. The blocks were recommended for children that were three years of age and older. During play time, one of the children threw a block onto their own great toe on the right foot. The child required professional medical attention and was diagnosed with a fractured toe.

    591-1-1-.07(2) · Rule 591-1-1-.07(2) requires that Parents be immediately notified and specific instructions obtained until the child can be picked up or returned to the group, immediately when professional medical attention is required, or when the child experiences symptoms of moderate discomfort, or when the child is involved in an incident that puts their health and/or safety at risk and to notify Parents by the end of the day when professional medical attention is not required, when the child experiences symptoms of less than moderate discomfort or when the child experiences an adverse reaction to prescribed medication which does not constitute moderate discomfort.

    During an investigation, it was determined that on February 23, 2026, at approximately 5:08 p.m., the staff failed to immediately notify the parents of 2-year-old child that the child had sustained a toe injury. During play time, the child threw a block onto their own great toe on the right foot. The child showed signs of discomfort and distress while at the center, and the parents were not notified of the incident until the child was picked up at approximately 5:30 p.m. The child received professional medical attention and was diagnosed with a fractured toe.

    During an investigation, it was determined that the center staff did not notify the Department within 24 hours or on the next work day that on February 23, 2026, a 2-year-old child received professional medical attention after throwing a large hollow block and sustaining a fractured toe.
