    591-1-1-.11(2) · Rule 591-1-1-.11(2) requires that personnel shall not: physically or sexually abuse a child or engage or permit others to engage in sexually overt conduct in the presence of any child enrolled in the center.

    During an investigation, it was determined that on August 8, 2023, at 5:00 p.m., while in restroom, a staff member hit a three-year-old child on the buttocks as a form of discipline. Investigative findings, which include video footage, indicated that a staff member can be observed walking over to a shelf and retrieving a stick. The staff then entered the restroom and proceeded to spank the three-year-old with a stick due to the child having a bowl movement in their pull-up diaper. The incident resulted in the three-year-old child sustaining several marks, bruises, and welts on the child’s buttocks.
