591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm¶s length away from children thirty- six (36) months of age and younger.
During an Incident Investigation Closure conducted on June 14, 2024 ; It was determined based on an investigation that on February 14, 2024, that a one-year-old child sustained a knot and bruise on the forehead when another child pushed them and hit their head on the table. The staff member had their back turned away from the children while standing in the doorway while talking to another staff member.

During a Complaint Closure conducted on August 28, 2024 ; It was determined based on an investigation that included staff interviews, staff written statements and a review of records that on August 9, 2024 a two-year-old child was observed with a braid missing from their head and staff was unaware of the child's hair loss. The hair was found the on the classroom floor.

During an Incident Investigation Closure conducted on November 15, 2024 ; It was determined based on review of documents, interviews and statements that on September 16, 2024, at approximately 4:00 p.m., center staff failed to provide watchful oversight when a six-year-old child was cut on the forehead by another child who had a pair of scissors. Staff responsible for the child was unaware of the incident until other children informed them of the incident. Professional medical care was obtained as a precaution. Exhibit "A"
