591-1-1-.03(9) · Rule 591-1-1-.03(9) requires center staff to refrain from engaging in, or allowing children or other adults to engage in activities that could be detrimental to a child’s health or well-being, such as but not limited to, horse play, rough play, wrestling, and picking up a child in a manner that could cause injury.

During an investigation, it was determined that on January 18, 2023, the center allowed a child to engage in an activity that could cause injury when on January 18, 2023, a two-year-old child climbed onto a chair, stood up and fell off of the chair injuring their mouth. Staff were aware that the children had been playing with the chair and did not physically intervene to prevent the children from climbing on the chair and to assist the child in getting down from the chair to prevent injury. The child required professional medical attention as a result of the incident.

591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.

During an investigation, it was determined that on April 27, 2021, adequate supervision was not provided when a two-year-old child was left outside on the playground for approximately 39 minutes. The child did not receive medical attention. The child was found when the parent came to pick the child up. The center had no knowledge the child was missing until the parent came to the center to pick the child up from the premises.
