During a Complaint Closure conducted on October 7, 2024, it was determined based on an investigation that on August 16, 2024, a staff member handled a two-year-old child roughly and isolated the child when they grabbed the child by the arm and placed the child at a table located in the back of the classroom as a form of discipline. It was further determined that on August 16, 2024, the same staff member handled the same child roughly when they grabbed the child by the arm as a form of discipline when the child and another child were jumping on cots, collided and one of the two-year-old children became injured. The child sustained an adult sized finger shaped bruise across their upper arm as a result of being handled roughly by the staff member.

Staff were not seated within an arm’s length away from the child.

During a Complaint Closure conducted on May 14, 2024, it was determined based on an investigation that on April 1, 2024, a staff member physically abused a one-year-old child during naptime in the 2L Toddler Classroom on this date. The staff member applied physical force in efforts of making the child go to sleep, as the staff member repeatedly slammed the child onto a cot. The staff member repeatedly pushed and held the child’s head onto the cot, and aggressively rocked and patted the child’s back. The child was forcibly thrown in the back left corner, where the child’s back was against the wall. As a result of the incident, the child received professional medical attention. The child was diagnosed with a bruise and a small hematoma to their forehead, as well as bruising to their bilateral upper arms. The staff member handled the child roughly and failed to protect the child from willful injury while at the center. An adverse action was previously issued for this rule violation. This rule violation is no longer appealable. No fine is being issued at this time.

Rule 591-1-1-.31(13) prohibits Center Staff from committing any criminal act, as defined under Georgia law, in the presence of any child enrolled in the Center and requires Center staff to comply with all applicable laws and regulations. During an investigation, it was determined that on April 17, 2024, a staff member was charged and arrested with first-degree cruelty to children after an incident that occurred on April 1, 2024. A staff member physically abused a one-year-old child during naptime in the 2L Toddler Classroom on this date. As a result of the incident, the child received professional medical attention and sustained injuries to their head and arms. The staff member was arrested and charged with 4 Counts of Cruelty to Child in the 1st degree.

The center reported the incident to the Division of Family and Children Services on April 1, 2024. The center did not report the incident and subsequent report made to the Division of Family and Children Services to The Department until April 4, 2024. The center failed to notify the Department within the required twenty-four (24) hours or the next work day as required.
