    591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm¶s length away from children thirty- six (36) months of age and younger.

    During a Complaint Closure conducted on April 3, 2023 ; It was determined, based on investigative findings, that on February 8, 2023, a staff member was observed to be on their cell phone while in the toddler classroom and was not providing watchful oversight as required . Additionally, on February 9, 2023, a one-year-old child was bitten and staff were not aware of how the incident occurred. It was further determined that on February 13, 2023, staff did not provide watchful oversight when a one-year- old child sustained multiple bite marks while in the classroom and staff did not take adequate measures to maximize their ability to respond promptly to the needs and actions of the children being supervised. Professional medical attention was obtained. An adverse action was previously issued for this rule violation. This rule violation is no longer appealable. No fine is being issued at this time.

    During a Complaint Investigation & Monitoring Visit conducted on June 23, 2023 ; It was determined based on observation and interview that on June 23,2023, children were not provided adequate supervision in Room D 4th left when staff # 3 left children unattended to answer the front door for the consultant. Additionally, during consultant's time of arrival, it was observed that a child from Room F Right rear walked through the halls to the front office to obtain a trash bag out of the office without staff supervision. Lastly, children from Room F right rear walked through the hallway of the center unsupervised after returning from the playground. Exhibit "A"
