591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.
During an investigation, it was determined that on October 13, 2025, at approximately 10:49 a.m. on the playground, a 3-year-old child was left alone and unsupervised for approximately 30 minutes. Two staff members took 19 children to the playground. When transitioning into the classroom staff failed to complete a name to face check resulting in a 3-year-old child being left alone on the playground. Staff were unaware the child was left until approximately 30 minutes later when another staff member observed the child alone on the playground. Management was notified and the child was retrieved from the playground and returned to their classroom.

During an investigation, it was determined that watchful oversight was not provided on September 29, 2023, when a two-year-old child was left alone on the playground unsupervised. As staff prepared to leave the playground to return to the two-year-old classroom, staff failed to conduct a face-to-name check. As a result, the two-year-old child was left on the playground unsupervised for an undetermined amount of time. Staff were alerted to the child being left alone on the playground, when a contractor knocked on the door of the one-year-old classroom, stating that the child had been left on the playground.
