    591-1-1-.03(9) · Rule 591-1-1-.03(9) requires center staff to refrain from engaging in, or allowing children or other adults to engage in, activities that could be detrimental to a child's health or well-being, such as but not limited to, horse play, rough play, wrestling, and picking up a child in a manner that could cause injury.

    It was determined based on an investigation that on August 20, 2025, at approximately 9:55 a.m. on the infant/toddler playground, center staff failed to properly intervene and deter a 2-year-old child from engaging in unsafe play when they became aware that the child was going up the tube slide. Staff failed to redirect the child from using the equipment in an unsafe manner. The 2-year-old child fell while ascending the slide and injured their mouth. Professional medical attention was received for an injury to their lip. 2. 591-1-1-.26(6) requires that playground equipment provide an opportunity for the children to engage in a variety of experiences and shall be age-appropriate. For example, toddlers shall not be permitted to swing in swings designed for School-age Children. The outdoor equipment shall be free of lead-based paint, sharp corners and shall be regularly maintained in such a way as to be free of rust and splinters that could pose significant safety hazard to the children. All equipment shall be arranged so as not to obstruct supervision of children. It was determined based on an investigation that on August 20, 2025, center staff failed to ensure that the playground slide was maintained free from hazards as required when three protruding nails were observed at the top of the slide where the edge meets the wooden platform of the playground structure.
