591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children shall be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. “Supervision” means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in- Training, and provide timely attention to the children’s actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.
During an incident investigation, it was determined that on April 24, 2024, a three-year-old child ran into another three-year-old child while in the classroom. On April 24, 2024, at 5:15 p.m. there was a ratio of two staff members and five children present in the classroom at the time of the incident. Staff statements indicated that the children had been instructed to stop running and were redirected by staff member B. Video footage revealed that a three-year-old child was running toward the carpet area. Another three-year-old child got up from the carpet and ran in the direction of the other three-year-old child, both children collided with one another. At the time of the incident, Staff member A had returned from the laundry room with a mop and bucket and Staff member B had retrieved a vacuum cleaner and was moving towards a door that led to another classroom when the incident occurred. Both children were injured and were transported by their parents to a medical facility to obtain professional medical attention.

Additionally there is chipping paint along the base boards and the doors. ---The consultant observed 3 x 7 inch rip in the carpet, exposing frayed edges, located in the middle one- year-old classroom near the air vent in the floor by the entrance door. ---The consultant observed a 2 x 7 inch and a 1 x 2 inch rip in the wall on the right side of the hand washing sink exposing sheet rock in the middle one-year-old classroom. Additionally, the consultant observed multiple areas within this classroom that was chipping paint and in need of repair.
