591-1-1-.25(3) · Rule 591-1-1-.25(3) requires that the Center and surrounding premises shall be kept clean, free of debris and in good repair. Hygienic measures such as, but not limited to, screened windows and proper waste disposal procedures shall be utilized to minimize the presence of rodents, flies, roaches and other vermin at the Center.
During an investigation, it was determined that on January 23, 2026, at approximately 11:20 a.m. a 4-year-old child cut the top of their right hand on a piece of metal that was protruding from a bolt located on an outside brick wall. As children were lining up along the wall to go inside from the playground, the 4-year-old child reached their hand back to hold the hand of a classmate. The back of the child’s hand came in contact with a piece of metal that was protruding from the wall, resulting in a cut on the child’s hand. The child received professional medical attention for treatment of the cut.

591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in- Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.

It was determined, based on an investigation, that on October 7, 2024, at approximately 9:50 a.m., a 4-year-old child was not being adequately supervised when another child threw a chair, striking the 4-year-old in the head. Video footage revealed a child began throwing toys and other objects hitting staff and children for approximately two minutes. The child proceeded to pick up a chair, walk over to the child and throw it at their head. At the time of the incident, staff failed to provide watchful oversight when one staff member was on the opposite side of the table, and another had their back to the class standing near the cubbies.
