591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.
During an investigation, it was determined that on November 24, 2025, staff were not properly positioned to provide adequate supervision when a 6-year-old child fell and fractured their right wrist. At approximately 12:24 p.m., three staff members and sixteen children were on the playground. The three staff members were located near a slide structure and engaged in conversation while two children were walking on a wooden beam that surrounded the swings and measured 8 inches in height. The two children pushed each other while on the wooden beam, causing the 6-year-old child to fall to the ground. The child remained lying on the ground and began to cry. Professional medical attention was obtained, and the child was diagnosed with a fractured wrist.

Hygienic measures such as, but not limited to, screened windows and proper waste disposal procedures shall be utilized to minimize the presence of rodents, flies, roaches and other vermin at the Center.
During an investigation, it was determined that on October 13, 2025, a stair rail adjacent to the building was not safe when a 3-year-old child fell through a gap in the railing and fell to the ground. During the incident, staff members were transitioning a group of children from the playground back into the building. When the children were lined up at the top of the stairs that led to the building, a 3-year-old child leaned against the stair rail and fell through an 8- inch gap. The child fell approximately 5 feet, 2 inches and landed on the ground. The child received professional medical attention for a broken collarbone.
