591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.
During an investigation, it was determined that on July 2, 2025, at approximately 4:47 p.m. children were not adequately supervised when a 3-year-old child fell through a child sized piece of furniture and sustained a serious mouth injury. During group time on the carpet, the child wandered away from the group and moved a chair next to a jungle tree house. The child used the chair to climb on top of the tree house, which measured 31 inches in height. The child began to jump, eventually falling through an acrylic porthole located on the top. The child received professional medical treatment for a lip laceration. Staff were not aware that the child was on top of the tree house until after the child began to jump.

During an investigation, it was determined that on May 11, 2021, at approximately 10:00 a.m., a four-year-old child sustained an injury to the right arm, when the child fell on the playground. While walking on the playground, the teacher observed the child sitting at the end of a slide, holding their arm. The staff person did not check on the child to determine if the child was injured. A short time later, the child approached the teacher and reported the arm injury. The staff person responsible for the child did not know that the child was injured or how the injury occurred until the child reported the injury. The child was unable to use the arm for the remainder of the day to do routine activities and tasks. Professional medical attention was sought for the child as a result. The child was diagnosed with a fractured arm. 2. Rule 591-1-1-.07(2) Parents must be notified of a child's illness or injury as follows: Immediately notify Parent(s) and obtain specific instructions until child can be picked up or returned to group when professional medical attention is required, or when child experiences symptoms of moderate discomfort such as elevated temperature, vomiting or diarrhea. During an investigation, it was determined that on May 11, 2021, center staff failed to notify parents when a four- year-old child showed signs of unusual behavior and discomfort throughout the day. The child fell on the playground at approximately 10:00 a.m. and sustained an arm injury. The director called the parent at approximately 10:00 a.m. but did not get a response. No follow-up calls were made until the director was notified by a another teacher at approximately 3:00 p.m. that the child was favoring their arm. The investigation revealed that the child had not used the arm since falling earlier in the day. The staff member in charge of the child had to assist the child with routine activities and tasks after the fall. The child was picked up and received professional medical attention. The child was diagnosed with a fracture to their right arm.
