    591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in- Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.

    It was determined based on an investigation that on March 26, 2024, at an undetermined time between 3:40 p.m. and 4:00 p.m. center staff failed to provide watchful oversight when they did not see a two-year-old child place their finger on the door frame as the door closed on the two-year-old child's finger. A center staff member opened a door leading from the pre-toddler playground to a breakroom. Two staff members stood at the door and spoke for a few moments and were unaware that the child had placed their hand in the door frame on the hinge side of the door. One staff member closed the door as they entered the building. The child sustained an injury to their left pinky finger. Professional medical attention was required.

    591-1-1-.25(3) · Rule 591-1-1-.25(3) requires the Center and surrounding premises to be kept clean, free of debris and in good repair. Hygienic measures such as, but not limited to, screened windows and proper waste disposal procedures shall be utilized to minimize the presence of rodents, flies, roaches and other vermin at the Center.

    It was determined based on an investigation that on March 26, 2024, center staff failed to ensure that the door that led from the break room to the playground was in good repair and would close completely when shut. On March 26, 2024, a two-year-old child's fingers were closed in a door. Professional medical attention was required to treat a finger injury to the left pinky finger. The door that led from the playground to the center was not in good repair. When staff closed the door, the door would remain partly open and sometimes would require the use of force to ensure that the door was completely closed. Before the incident, the staff member's two attempts to fully close the door were unsuccessful. The incident occurred while the staff member attempted to close the door for a third time.
