    591-1-1-.03(9) · Rule 591-1-1-.03(9) requires center staff to refrain from engaging in, or allowing children or other adults to engage in, activities that could be detrimental to a child's health or well-being, such as but not limited to, horse play, rough play, wrestling, and picking up a child in a manner that could cause injury.

    It was determined that on February 7, 2023 staff members in the Toddler Two classroom allowed two-year-old children to run around the classroom and did not intervene; as a result, a two-year-old child fell, and professional medical attention was obtained. It was further determined that a staff member in the Toddler Two classroom roughly handled an injured child after the child fell while running around in the classroom. The staff member roughly placed the child on the diaper changing table, roughly pulled the child's pants up and down over the injured leg and made multiple attempts in a rough manner to make the child stand on their injured leg.

    591-1-1-.03(8) · Rule 591-1-1-.03(8) requires a center to provide individual attention to each child by responding promptly to the child's distress signals and need for comfort.

    It was determined that on February 7, 2023, center staff did not provide individual attention to a two-year-old child who fell and injured their leg while running in the classroom. After the child fell, the child remained on the floor and cried for approximately one minute. A staff person picked the child up to diaper the child and then placed the child on the floor where the child remained in distress and unable to move for approximately another fifteen minutes. The child’s parent was contacted and took the child for professional medical treatment. 3. A. 591-1-1-17(7) requires that children wash their hands with liquid soap and warm running water upon arrival for care, when moving from one child care group to another, upon re-entering the child care area after outside play, before and after eating meals and snacks, handling or touching food, playing in water; after toileting and diapering, playing in sand, touching animals or pets, and contact with bodily fluids and after contamination by any other means. It was determined based on investigation, that the center failed to follow proper hand washing procedures on May 12, 2022, when they failed to have children wash hands with liquid soap and warm running water upon arrival and before eating meals and snacks, as staff used germ killing wipes or hand sanitizer to clean children's hands throughout the day. 3. B. 591-1-1-17(7) requires that children wash their hands with liquid soap and warm running water upon arrival for care, when moving from one child care group to another, upon re-entering the child care area after outside play, before and after eating meals and snacks, handling or touching food, playing in water; after toileting and diapering, playing in sand, touching animals or pets, and contact with bodily fluids and after contamination by any other means. It was determined based on investigation that on February 7, 2023, that staff diapered four children and did not wash the children's hands after diapering. Corporation Service Company 4. A. 591-1-1-.17(8) requires staff to wash their hands with liquid soap and warm running water upon arrival for the day, when moving from one child care group to another, upon re-entering the child care area after outside play, before and after diapering each child, dispensing medication, applying topical medications, handling and preparing food, eating, drinking, preparing bottles, feeding each child, assisting children with eating and drinking, after toileting or assisting children with toileting, using tobacco products, handling garbage and organic waste, touching animals or pets, handling bodily fluids and after contamination by any means. It was determined based on investigative findings on May 16, 2022, that staff failed to wash their hands upon arrival to the classroom or when entering another classroom with warm running water and liquid soap. 4. B. 591-1-1-.17(8) requires staff to wash their hands with liquid soap and warm running water upon arrival for the day, when moving from one child care group to another, upon re-entering the child care area after outside play, before and after diapering each child, dispensing medication, applying topical medications, handling and preparing food, eating, drinking, preparing bottles, feeding each child, assisting children with eating and drinking, after toileting or assisting children with toileting, using tobacco products, handling garbage and organic waste, touching animals or pets, handling bodily fluids and after contamination by any means. It was determined based on investigative findings that on February 7, 2023, center staff did not wash hands in between diapering four children.
