During a Complaint Investigation & Licensing Study conducted on March 7, 2023 ; It was determined, based on observation, that the following potential hazards were observed accessible to children on this date: - Room G - An unlocked closet was observed to contain staff purses and cleaning supplies on this date. Wipes and gloves were observed accessible to children on the top of the Rubbermaid storage drawers near the bathroom. - Room H - An unlocked closet was observed to contain staff purses, a broom, a dust pan, and cleaning supplies.

During an Incident Investigation Closure conducted on December 29, 2022 ; It was determined based on investigation that on November 2, 2022, a three-year-old child was inappropriately disciplined when a staff person placed the child in a classroom restroom and held the door closed to correct the child's behavior. It was further determined that on an undetermined date in October, the same child was kicked by a staff person when the three-year-old child kicked the staff person, while on the playground. An adverse action was previously issued for this rule violation. This rule violation is no longer appealable. No fine is being issued at this time.

During a Complaint Closure conducted on July 17, 2023 ; It was determined based on investigative findings that on June 9, 2023, a staff member aggressively grabbed a five-year-old child's elbow because the child was painting on their own hand and would not stop painting their own hand when instructed to. It was determined that on February 7, 2023 staff members in the Toddler Two classroom allowed two-year-old children to run around the classroom and did not intervene; as a result, a two-year-old child fell, and professional medical attention was obtained. It was further determined that a staff member in the Toddler Two classroom roughly handled an injured child after the child fell while running around in the classroom. The staff member roughly placed the child on the diaper changing table, roughly pulled the child's pants up and down over the injured leg and made multiple attempts in a rough manner to make the child stand on their injured leg.

It was determined that on February 7, 2023, center staff did not provide individual attention to a two-year-old child who fell and injured their leg while running in the classroom. After the child fell, the child remained on the floor and cried for approximately one minute. A staff person picked the child up to diaper the child and then placed the child on the floor where the child remained in distress and unable to move for approximately another fifteen minutes. The child’s parent was contacted and took the child for professional medical treatment. 3. A. 591-1-1-17(7) requires that children wash their hands with liquid soap and warm running water upon arrival for care, when moving from one child care group to another, upon re-entering the child care area after outside play, before and after eating meals and snacks, handling or touching food, playing in water; after toileting and diapering, playing in sand, touching animals or pets, and contact with bodily fluids and after contamination by any other means. It was determined based on investigation, that the center failed to follow proper hand washing procedures on May 12, 2022, when they failed to have children wash hands with liquid soap and warm running water upon arrival and before eating meals and snacks, as staff used germ killing wipes or hand sanitizer to clean children's hands throughout the day. 3. B. 591-1-1-17(7) requires that children wash their hands with liquid soap and warm running water upon arrival for care, when moving from one child care group to another, upon re-entering the child care area after outside play, before and after eating meals and snacks, handling or touching food, playing in water; after toileting and diapering, playing in sand, touching animals or pets, and contact with bodily fluids and after contamination by any other means. It was determined based on investigation that on February 7, 2023, that staff diapered four children and did not wash the children's hands after diapering. Corporation Service Company 4. A. 591-1-1-.17(8) requires staff to wash their hands with liquid soap and warm running water upon arrival for the day, when moving from one child care group to another, upon re-entering the child care area after outside play, before and after diapering each child, dispensing medication, applying topical medications, handling and preparing food, eating, drinking, preparing bottles, feeding each child, assisting children with eating and drinking, after toileting or assisting children with toileting, using tobacco products, handling garbage and organic waste, touching animals or pets, handling bodily fluids and after contamination by any means. It was determined based on investigative findings on May 16, 2022, that staff failed to wash their hands upon arrival to the classroom or when entering another classroom with warm running water and liquid soap. 4. B. 591-1-1-.17(8) requires staff to wash their hands with liquid soap and warm running water upon arrival for the day, when moving from one child care group to another, upon re-entering the child care area after outside play, before and after diapering each child, dispensing medication, applying topical medications, handling and preparing food, eating, drinking, preparing bottles, feeding each child, assisting children with eating and drinking, after toileting or assisting children with toileting, using tobacco products, handling garbage and organic waste, touching animals or pets, handling bodily fluids and after contamination by any means. It was determined based on investigative findings that on February 7, 2023, center staff did not wash hands in between diapering four children.

During an investigation, it was determined that on November 2, 2022 staff inappropriately disciplined a three-year- old child in the classroom. Video footage revealed that a three-year-old child was resisting as the child entered the classroom. The staff person grabbed the child by the hand and pulled the child into the classroom who continued resisting. The staff person and child tripped over a cot and fell on the floor. The staff person and child stood up and the staff person dragged the child by both hands to the bathroom. The staff person placed the child in the bathroom for 17 seconds as the staff person held the door shut. Staff statements further revealed that on an unknown date in October, while outside on the playground, the three-year-old child kicked a staff person, and the staff person kicked the child back on the child’s leg.

During an investigation, it was determined based on investigative findings that on August 30, 2021, a two-year-old child was put in the bathroom, the lights were cut off, the door was shut, and a toy shelf was placed in front of the door to prevent the child from exiting the bathroom as a form of discipline. The child remained isolated in the dark bathroom for more than two minutes and thirty-five seconds. The child did not require professional medical attention.
