    591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in- Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.

    During an incident investigation conducted on November 3, 2022, it was determined based on investigative findings that on October 17, 2022, a lack of supervision occurred, when one staff member was standing in an open door between the playground and classroom while a child was in the classroom using the bathroom and a three-year-old child fell and hit their head on the outdoor play equipment, which caused them to sustain a gash to their head which required medical attention and stitches.

    During an incident investigation conducted on November 3, 2022, it was determined based on review of records that a serious injury occurred that required medical attention on October 17, 2022 and the center did not report to the Department until October 21, 2022, which is not within the twenty-four (24) hour requirement.

The staff member was standing by the counter warming a bottle and not seated within arm's length away from the infants. An adverse action was previously issued for this rule violation. This rule violation is no longer appealable. No fine is being issued at this time.

    During an Incident Investigation by Phone conducted on November 8, 2021 ; It was determined based on investigative findings that on October 29, 2021 a center staff member slapped a three-year-old child on the cheek as a form of discipline after the child was observed to drink from another child's cup.

Professional medical attention was required, and the child was treated for a broken arm. Video footage did not show the child fall from the slide, however it showed that children were hanging from the side of the play structure, but staff failed to redirect or physically intervene. The four-year-old child stated that they were attempting to reach for a bar on the side of the slide so that they could hang from the side of the structure when they fell. An enforcement fine was previously issued for this rule violation. This rule violation is no longer appealable. No fine is being issued at this time.

As a result, a five-year-old child jumped from the swing and fell to the ground. Professional medical attention was obtained for the child’s injury. Video footage showed the child jumping from the swing. Additionally, a staff member was stationed at the corner of the swing set. Staff statements and interviews revealed that the child was seen by staff swinging in a manner that was excessively high but did not intervene.
