    591-1-1-.11(2) · Rule 591-1-1-.11(2) requires that personnel shall not: physically or sexually abuse a child or engage or permit others to engage in sexually overt conduct in the presence of any child enrolled in the center; inflict corporal/physical punishment upon a child; shake, jerk, pinch or handle a child roughly; verbally abuse or humiliate a child which includes, but is not limited to, the use of threats, profanity or belittling remarks about a child or his family; isolate a child in a dark room, closet or unsupervised area; use mechanical or physical restraints or devices to discipline children; use medication to discipline or control children's behavior without written medical authorization issued by a licensed professional and given with the parent's written consent; restrict unreasonably a child from going to the bathroom; punish toileting accidents; force-feed a child or withhold feeding a child regularly scheduled meals and/or snacks; force or withhold naps; allow children to discipline or humiliate other children; or confine a child for disciplinary purposes to a swing, highchair, infant carrier, walker or jump seat.

    During an investigation, it was determined that on June 2, 2025, at 10:20 a.m., a 5-year-old child was inappropriately disciplined while on the playground. The center staff member aggressively grabbed the child by their left arm, resulting in a red bruise and minor scratches. The child was instructed three times to sit in timeout after pushing another child. The child refused and was placed in timeout by a staff member. After being placed in timeout, the child threw a water bottle toward the staff member’s head. The staff then aggressively grabbed the child by their left arm. The child sustained a red bruise and minor scratches. The child required professional medical attention. The center staff failed to refrain from physical force and rough handling of the child as a result of the incident.

    During an investigation, it was determined that on June 2, 2025, at 10:20 a.m., a 5-year-old child was inappropriately disciplined by a staff member while on the playground. The staff member engaged in criminal acts in the presence of children while at the center. The staff member applied physical force in efforts to correct the child's behavior. The staff member was arrested on June 4, 2025, and charged with simple assault, simple battery, and battery.

    During an investigation, it was determined that on July 11, 2025, at approximately 2:50 p.m., a 3-year-old child sustained a head injury that required professional medical treatment. According to staff statements on July 14, 2025, the administrator was notified by the child’s parents that the child would be taken to a medical facility to receive professional medical attention. As required by the Department, the center failed to report the incident within the required 24 hours or the next workday on July 15, 2025.

    591-1-1-.36(4)(f)1. · Rule 591-1-1-.36(4)(f)1. requires that all transported children be secured in a child passenger restraining system or seat safety belt in accordance with current state and federal laws and regulations and according to manufacturer's directions.

    During an investigation, it was determined that on February 28, 2023, at approximately 3:00 p.m., center staff did not ensure that all school age children being transported were secured in a child passenger restraining system. As a result, children were thrown to the floor during an automobile accident in the child care vehicle. 2. Rule 591-1-1-.31(13) prohibits Center Staff from committing any criminal act, as defined under Georgia law, in the presence of any child enrolled in the Center and requires Center staff to comply with all applicable laws and regulations. During an investigation, it was determined that on February 28, 2023, at approximately 3:00 p.m., center staff did not comply with all applicable laws when the driver of the child care vehicle was involved in an automobile accident while school age children were on board. Some of the children were thrown to the floor and required professional medical attention. The driver received a citation for the accident.
