591-1-1-.15(9) · Rule 591-1-1-.15(9) requires that a written statement be on file from a medical authority when a child requires a modified diet for medical reasons and from the child's Parent(s) when a child requires a modified diet for religious reasons. All caregiver Personnel shall be informed of the diet restriction for the child and only food that complies with the prescribed dietary regimen but still meets the food and nutrition requirements shall be served to the child.

During an investigation, it was determined that on February 26, 2026, at approximately 5:45 p.m., a 2-year-old child with a need for a modified diet consumed a food that contained ingredients to which the child was allergic. During evening snack, a staff member observed a graham cracker in the 2-year-old child’s mouth. The graham cracker contained milk, wheat, and soy, which were allergens indicated on the child’s enrollment form; however, the staff member was unaware of the child’s need for a modified diet until being informed by another staff member. When the parent arrived for pickup at approximately 6:20 p.m., the parent noticed that the child was showing signs of an allergic reaction. The child was taken to the hospital by emergency medical services for treatment.
