591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children shall be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. “Supervision” means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children’s actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.
During an investigation, it was determined that on July 29, 2025, at 11:55 a.m., children were not adequately supervised when a 4-year-old child fell out of a chair and sustained a head injury. One staff member was present with fourteen 3-year-old and 4-year-old children in the classroom. The teacher stood at the front of the classroom, reading to the children as they were seated at tables. The 4-year-old child sat in a chair and had their arms and legs inside of their shirt. As the child removed their arms and legs from their shirt, they fell from the chair, hitting the right side of their head on the floor. The teacher did not see the child fall but heard a thump and asked the children what happened. The 4-year-old child cried and rubbed their head. The teacher realized that the child hit their head and then provided aid. At approximately 2:30 p.m., the child complained of head pain and the child’s parent was contacted. Professional medical attention was obtained, and the child was diagnosed with a head injury. Staff failed to ensure that the child was sitting in the chair appropriately to prevent injury.

During an investigation, it was determined that on December 1, 2021, a one-year-old child sustained an injury to the mouth when a staff member pushed the child onto the cot when the child would not lay down. Professional medical attention was obtained, and the child received stitches to their mouth.

During an investigation, it was determined that on August 4, 2021, during morning transportation, center staff failed to include the first and last name of a five-year-old child on the transportation checklist. The child raised their hand when another child’s name was called for a different school not attended by the victim child. The staff member did not recognize that the child who the victim child raised their hand for was absent, nor did they recognize the victim child. Staff dropped the victim child off at the incorrect elementary school. Approximately thirty minutes later, the school principal called the center to report the error. An enforcement fine was previously issued for this rule violation. This rule violation is no longer appealable.

591-1-1-.29(3) · Rule 591-1-1-.29(3) requires the Director or designated person-in-charge shall report or cause to be reported to the Department within twenty-four (24) hours or the next work day: any death of a child while in the care of the Center; any serious illness or injury requiring hospitalization or professional medical attention other than first aid of a child while in the care of the Center; any situation when a child in care becomes missing, such as, but not limited to, a child who is left on a vehicle, a child who leaves the building, playground, or property, or a child who is left behind on any trip; any fire; any structural disaster; any emergency situation that requires temporarily relocating children; and any time the program’s operating status changes (i.e., open to closed or temporarily closed and temporarily closed to open).
During an investigation, it was determined that on August 4, 2021, center staff failed to notify the Department within 24 hours or the next business day of an incident involving staff responsible for transportation dropping a five-year- old child off at an unauthorized location. The child was missing for approximately thirty minutes.

591-1-1-.36(9) · Rule 591-1-1-.36(9) requires that the Center is responsible for the child from the time and place the child is picked up until the child is delivered to his or her Parent(s) or the responsible person designated by his or her Parent(s). A child shall not be dropped off at any location if there is no one present authorized to receive the child.
During an investigation, it was determined that during morning school transportation on August 4, 2021, center staff dropped a five-year-old child off at an unauthorized location where there was no authorized person to receive the child. It was revealed that center staff was notified by the school principal of the incorrect elementary school where the victim child was dropped off. Staff reported that upon notification, center staff immediately went to the elementary school to retrieve the child and transport the victim child to the correct elementary school.

During an investigation, it was determined that on August 4, 2021, a five-year-old child was not supervised by an authorized adult and staff did not supervise the child for thirty minutes when center staff dropped the child off at the wrong school during morning transportation. The Principal of Grayson Elementary School contacted the center to inform them that the child was dropped off accidentally as the child was not an enrolled student and was actually enrolled at another elementary school. Center staff went to retrieve the child and take them back to the center. The child was then taken to the correct school.
