591-1-1-.15(9) · Rule 591-1-1-.15(9) requires when a child requires a modified diet for medical reasons, a written statement from a medical authority shall be on file. When a child requires a modified diet for religious reasons, a written statement to that effect from the child's Parent(s) shall be on file. All caregiver Personnel shall be informed of the diet restriction for the child and only food that complies with the prescribed dietary regimen but still meets the food and nutrition requirements shall be served to the child.
During an investigation, it was determined that on August 13, 2025, a 2-year-old child was served a food item containing an ingredient that the child was allergic to. There were two staff members and 17 children in the classroom. At approximately 2:30 p.m., Staff A placed a plate with watermelon and trail mix on the table in front of the 2-year-old child. While on the playground Staff B observed bumps on the 2-year-old child’s arms. Staff statements revealed that Staff B thought the 2-year-old child had been bitten by mosquitoes, so bug spray was administered to the arms of the child. At approximately 3:50 p.m., the Parent of the 2-year-old child arrived and noticed that the child’s eyes were red, and they were breaking out in hives on their body. The Parent asked if the 2- year-old child had been served nuts and was informed the child was not served nuts. On August 13, 2025, the Parent transported the 2-year-old child to a medical facility where they were treated for an allergic reaction and sent home with medication. The Department determined that the center failed to adhere to the 2-year-old child’s modified diet when the child was served trail mix. The child had an allergic reaction and professional medical attention was required.
