591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children shall be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. “Supervision” means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children’s actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.
During an incident investigation closure conducted on November 20, 2024, it was determined that on October 25, 2024, at 4:27 p.m., a four-year-old child was not adequately supervised when center staff left the child outside alone on the playground for approximately 20 minutes. Additionally, the exact times are unknown, the attendance sheet indicates that there is no record of the sign-out. The staff failed to actively supervise and provide watchful oversight at the time of the incident. The times are an estimate that were provided in the required report submitted and based on the camera footage and the classroom schedule.

During an incident investigation closure conducted on July 18, 2024; It was determined that on May 15, 2024, children were not adequately supervised when a five-year-old child was pushed at the top of the slide and fell to the ground. A staff person was positioned in front of the steps to the large climber with their back to the children. The staff person was not aware the child had been pushed or that they fell, until alerted by another child, the child was unnoticed by the staff person for approximately 20 seconds. 2. B

During an investigation, it was determined that on May 15, 2024, a five-year-old child was not adequately supervised and was injured while on the playground. There were two staff and 32 children on the playground. While one staff person supervised children on the bike trail, the second staff person was positioned in front of the large climber with their back to the children. Another child pushed the five-year-old child and the child fell from the slide and landed on their left arm. The staff person was unaware the child had been pushed and had fallen. The child lay on the ground for approximately 14 seconds, and then stood and walked toward the teacher. Video revealed the staff appeared to have been alerted by another child, and the staff person looked in the direction of the slide area but did not move to provide assistance to the child. When the child walked closer, the staff observed the child was injured and provided assistance. Emergency medical services and the parent were contacted, and the child received professional medical attention. The five-year-old child was treated for a serious arm injury and was placed in a cast.
