    591-1-1-.25(13) · Rule 591-1-1-.25(13) requires that potentially hazardous equipment, materials and supplies be stored in a locked area inaccessible to children.

    During a Complaint Investigation & Monitoring Visit conducted on November 24, 2025 ; It was determined based on observation that the following hazards were observed to be accessible in the classrooms: -A-202: Hand sanitizer and Desitin were observed to be accessible in a child's bag. -C-204: Insect repellent and packages of wipes were observed to be accessible in a child's bag. -D-205: Desitin, antibacterial ointment, Vaseline and sunscreen were observed to be accessible in children's bags. Also, diaper creams and Vaseline were observed to be accessible on a changing table shelf. -F-213: Sanitizer spray was observed to be accessible in a child's bag. -G-214: Several packages of wipes were observed on a shelf and accessible. -L-227: A plunger and Swiffer were accessible near the children's handwashing sink. -Q-236-237: Two hand sanitizers, petroleum jelly, Aquaphor, three sunscreens, package of wipes, and insect repellent were accessible in children's bags. In an unlocked cabinet to the right, two bottles of peroxide were observed to be accessible. The third cabinet in the counter area was observed to be unlocked and there were balloons accessible. Also, the first cabinet was observed to be unlocked and two bottles of bleach, Flex disinfectant wipes, plastic grocery bags, Borax, Odo Ban, glass cleaner and hand soap were accessible. Further, in the clear storage drawer near the phone area, a can of Wizard air freshener, empty tape dispenser with a sharp edge, two staplers, and adult scissors were accessible.

    During a POI Follow Up conducted on January 28, 2026 ; It was determined based on observation that the following hazards were present and accessible in rooms: -C-204: Desitin diaper rash cream, CeraVe Moisturizing Cream, Vaseline, Burt's Bees Chapstick, insect repellent stick, and adult scissors were located in children's backpacks. -K-218-219: A dustpan and Swiffer were propped against the wall beside the children's toilet. -L-227: A plunger was located behind the toilet in the children's bathroom on the right. -Q-236-237: Aquaphor and two cans of sunscreen were located in Children's bags. Additionally, a can of Wizard air freshener and spray disinfectants were located in a clear storage drawer behind the teacher's desk under the phone.

    591-1-1-.36(4)(f)1. · Rule 591-1-1-.36(4)(f)1. requires that all transported children be secured in a child passenger restraining system or seat safety belt in accordance with current state and federal laws and regulations and according to manufacturer's directions.

    During a Complaint Investigation & Monitoring Visit conducted on November 24, 2025 ; It was determined based on observation that the seat belts in row three and four were observed to be twisted and three car seats were observed to be expired in vehicle tag number LTE 4887. In vehicle SBT 2439, the first row seat belt buckle was observed to be broken, three seat belts were twisted, one car seat was expired and one did not have a sticker with a date. Also, vehicle tag number PB777, two car seats were observed to be expired, there were two broken seat belt buckles in the fourth row and one seat belt was not retracting in the fourth row to the right.

    During an Incident Investigation Closure conducted on December 30, 2025 ; It was determined based on an investigation that on October 27, 2025, at approximately 9:45 a.m. a 3-year-old child was injured while in care. The staff did not provide adequate supervision when they were not alert or positioned to hear and see the children at all times when they did not check around the door for children upon exiting the gym. As a Staff member exited the gym, a 3-year-old child placed their finger in the door. The 3- year-old child was treated at a medical facility and was diagnosed with a closed fracture of the right index finger.

    During an investigation, it was determined that on October 27, 2025, a 3-year-old child sustained a right finger injury while in care at the center. There were two staff members and eight 3-year-old children in the gym at the time of the incident. The first staff person was interacting with a group of children near the restroom and the second staff person was redirecting two children engaged in rough play. Video footage revealed a 3-year-old child was standing near hinge side of the gym door when a third staff member, who was not assigned to the class, entered and then exited the gym. As the staff exited, child's finger was closed and trapped in the door. Upon hearing the child cry out, the first staff member opened the door and removed the child’s finger. Staff did not ensure the doorway was clear prior to closing the door. Professional medical attention was obtained, and the child was diagnosed with a right index finger injury.
