591-1-1-.03(9) · Rule 591-1-1-.03(9) requires center staff to refrain from engaging in, or allowing children or other adults to engage in, activities that could be detrimental to a child's health or well-being, such as but not limited to, horse play, rough play, wrestling, and picking up a child in a manner that could cause injury.

During an investigation, it was determined that on November 5, 2021, center staff allowed several children to play on a toddler couch inappropriately and failed to redirect or intervene. Video footage and staff statements indicated that a staff member observed several children, including the two-year-old child, climbing over the back of a toddler- sized couch and slide or roll into the seat and onto the floor. The staff member failed to redirect the children from playing inappropriately or move the couch back against the shelf. The staff member left the area to chase after a child who was reported to have a tantrum and a few seconds later, the two-year-old child ran to the staff member, crying and holding their shoulder. Staff reported that the child fell off the couch while playing inappropriately. Professional medical treatment was required, and the child was treated for a clavicle fracture.
