591-1-1-.03(9) · Rule 591-1-1-.03(9) requires that staff shall not engage in, or allow children or other adults to engage in, activities that could be detrimental to a child's health or well-being, such as but not limited to, horse play, rough play, wrestling, and picking up a child in a manner that could cause injury.

During an investigation, it was determined that on April 3, 2025, a staff member inappropriately picked up a 1-year- old child by their right arm and placed them down for a nap, resulting in the child sustaining an arm injury. Holding one arm, the staff member forcibly removed the child as they were seated at a table and walked the child to a mat. While walking toward the mat, the child tripped over the mat while the staff member was holding the child’s arm. The 1-year-old child received professional medical attention and was diagnosed with Nursemaid's elbow. 2. 591-1-1-.31(13) prohibits Center Staff from committing any criminal act, as defined under Georgia law, in the presence of any child enrolled in the Center and requires Center staff to comply with all applicable laws and regulations. It was determined based on an investigation that on April 3, 2025, a staff person inappropriately lifted a one-year- old child by the right arm, resulting in a diagnosis of Nursemaid’s elbow. The staff person was subsequently arrested in connection with the incident.
