591-1-1-.11(2) · Rule 591-1-1-.11(2) requires that Personnel not: physically or sexually abuse a child or engage or permit others to engage in sexually overt conduct in the presence of any child enrolled in the Center; inflict corporal/physical punishment upon a child; shake, jerk, pinch or handle a child roughly; verbally abuse or humiliate a child which includes, but is not limited to, the use of threats, profanity or belittling remarks about a child or his family; isolate a child in a dark room, closet or unsupervised area; use mechanical or physical restraints or devices to discipline children; use medication to discipline or control children's behavior without written medical authorization issued by a licensed professional and given with the parent's written consent; restrict unreasonably a child from going to the bathroom; punish toileting accidents; force-feed a child or withhold feeding a child regularly scheduled meals and/or snacks; force or withhold naps; allow children to discipline or humiliate other children; or confine a child for disciplinary purposes to a swing, highchair, infant carrier, walker or jump seat.
During an investigation, it was determined that at approximately 10:46 a.m. on July 28, 2025, a staff person in Classroom G allowed children to discipline a child. A staff person instructed a 9-year-old child and a 4-year-old child to physically harm a 6-year-old child while the staff person and other children present in the classroom watched. The staff person then forcefully grabbed the 6-year-old child, swung the child in a chair, and shook the child several times as a form of discipline. The child sustained a scratch and bruise on their cheek. 2. Rule 591-1-1-.31(13) prohibits Center Staff from committing any criminal act, as defined under Georgia law, in the presence of any child enrolled in the Center and requires Center staff to comply with all applicable laws and regulations. During an investigation, it was determined that on July 28, 2025, a staff member in Classroom G inappropriately disciplined a 6-year-old child in care. The staff member instructed a 9-year-old child and a 4-year-old child to physically fight the 6-year-child. In addition, the staff member forcefully grabbed the 6-year-old child by the arm, swung the child onto the seat of a chair, and shook the child several times. The child sustained a scratch and bruise on their cheek. The staff member was arrested on July 28, 2025, and charged with Cruelty to Children in relation to the incident.

591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.
During an investigation, it was determined that on July 28, 2025, for approximately 13 minutes, a staff member in Classroom G was unaware that a 6-year-old child was physically harming a 4-year old child when the 6-year -old child spanked the 4-year-old child on the child's bottom, hit the child repeatedly on the head with a toy, pushed the child causing them to hit the side of their face against the wall, and forced the child out of the classroom and into the hallway of the Center. During the incident, the staff member was seated against the wall on the front right side of the classroom. The staff member's view was obstructed by a wall in the classroom causing the 6-year-old child and 4-year-old child to be in an isolated corner.

During a Licensing Study and Complaint Investigation conducted on August 5, 2025, it was determined based on observation that no staff person was seated and within an arm's length away while three 1-year-old children were eating lunch in Classroom D. The staff person was observed to be assisting children that had finished their lunch and were not seated at the table.

During an investigation, it was determined that on October 28, 2021, children were not adequately supervised when a one-year-old child sustained a laceration on the cheek. A half door that prevents the children from accessing the area behind the diaper changing counter was left open. The staff person in the classroom was not aware the child walked through the doorway of the half door. The child fell and hit the side of their face on the lock on the open half door. The staff person was not aware the child followed her and did not witness the incident. Staff persons immediately rendered first aid and the child’s parent was notified. The child received professional medical treatment. The child was sedated, and the laceration was closed with stitches.
