591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the childcare area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.
It was determined based on an investigation that on February 18, 2025, at 8:40 a.m., a 7-month-old infant sustained bruises on their forehead and cheek after another child fell on top of the 7-month-old infant. There was one staff member and six infants in the classroom at the time of the incident. The 7-month-old infant was participating in tummy time on the floor and in a location where the staff person could not visibly observe the infant. The staff member was occupied with putting away the infant’s items in the kitchen area while the infant had tummy time on the floor. The staff member heard the 7-month-old cry and went to provide aid to the infant. The staff person observed another child on top of the 7-month-old child. The staff member observed two bruises on the infant’s face while providing first aid. The staff member notified the center management and reported the 7-month-old’s injuries. During pick up the infant’s parent was informed that another child fell onto the infant during tummy time. Staff failed to actively supervise and provide watchful oversight to the child while at the center which resulted in the 7- month-old child sustaining bruises to the forehead and cheek when participating in tummy time on the floor.
