591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children shall be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. “Supervision” means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children’s actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.
During an investigation, it was determined that on December 17, 2025, at approximately 10:28 a.m., children were not adequately supervised when a 2-year-old child burned their left hand on a hot glue gun. There were three staff members with fourteen 2-year-old children in the classroom. The children were participating in learning centers while the staff members were seated and working on holiday crafts. A hot glue gun was plugged into the wall and placed in a container underneath a staff member’s chair. The 2-year-old child suddenly stood up from the carpet, held their hand, cried, stomped their feet, and rubbed their left hand on their pants. The child then went over to a staff member for assistance. The staff member asked the child what happened and the child guided the staff member to the hot glue gun. The staff members were unaware of how the injury occurred until the child informed them. The child received professional medical treatment for a burn on the left hand.

Examples of items to be stored include non-food related products under pressure in aerosol dispensing cans, flammable and corrosive materials, cleaning supplies, poisons, insecticides, office supplies and industrial-sized or commercial buckets with a capacity of three gallons or more or any other similar device with rigid sides which would not tip over if a toddler fell into the container head first.

During a Licensing Study conducted on June 3, 2025, it was determined based on observation that in the 3rd Left Back classroom, baby wipes were present in a child's bookbag, and a box of rubber gloves were present on a shelf accessible to children. It was further determined that in the 4R classroom, sunscreen was present in a child’s bookbag accessible to children.

591-1-1-.12(2) · Rule 591-1-1-.12(2) requires equipment and furniture shall be free from hazardous conditions such as, but not limited to, sharp rough edges or toxic paint and shall be kept clean. Based on investigative findings which included interviews, statements, and a review of video footage, it was determined that on June 10, 2022, children were adequately supervised when a two-year-old child sustained a finger laceration after handling a cracked, plastic toy bin. At approximately 3:20 p.m., there were two staff persons with 11 children. As one staff person assisted children in the bathroom, the second staff person monitored the remaining children. The child removed the plastic bin from a low shelf and dumped the toys on the floor. The staff person directed the child to pick up the toys. The child put a couple toys back in the bin, then walked away. The staff person brought the child back to clean up the toys and saw blood on the plastic bin, then realized the child's finger was bleeding. The child was not crying and gave no indication of an injury. The staff person rushed the child to the sink to clean the finger and begin first aid. Management was notified and the injury was assessed. The child's parent was called. The child received professional medical treatment and the laceration was closed with stitches.
