591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm¶s length away from children thirty- six (36) months of age and younger.
During an Incident Investigation Closure conducted on August 28, 2025 ; It was determined based on an investigation that on July 31, 2025, at approximately 10:30 a.m., a 2-year-old child was standing on a slide's side wall on the playground and fell backwards. One staff member was standing behind the playground structure and did not witness the incident, while the other staff member was standing in the classroom door supervising the children inside the classroom. The center staff did not provide adequate supervision. An adverse action was previously issued for this rule violation. This rule violation is no longer appealable. No fine is being issued at this time.

During an investigation, it was determined that on July 31, 2025, at approximately 10:30 a.m., children were not adequately supervised when a 2-year-old child fell from a slide's side wall on the playground and the child fell off the slide. There were three staff members caring for 18 2-year-old children on the playground, at the time of the incident one staff member left the playground to go to the restroom. According to video footage, there were three children on the slide, one child was sitting on a riding toy in the middle of the slide, while two other children were standing on each side of the slide’s wall. One staff member was observed to be near the play structure, however behind the play structure and did not appear to redirect the children who utilized the play structure improperly. An additional staff member was observed standing in the doorway of the classroom assisting three children that were using the bathroom. During the incident, one child rolled a push toy up the slide, another child jumped off the slide’s side wall, and a third child fell backwards when attempting to pick up a riding toy. The 2-year-old child landed on their left arm and immediately started to cry. Staff statements revealed that staff verbally redirected the children several times by informing the children to not stand on the side walls of the slide. Staff failed to actively supervise and provide watchful oversight to the children on the playground, which resulted in an injury to the 2-year-old child’s left arm. The child required professional medical attention as a result of the incident.

591-1-1-.32(1) · Rule 591-1-1-.32(1) requires the Center to maintain the required Staff: child ratios as follows: under 1 year or under 18 months if not walking = 1:6; 1 year and walking = 1:8; 2 years = 1:10; 3 years = 1:15; 4 years = 1:18; 5 years = 1:20;and 6 years and older = 1:25. A Center must establish groupings of children for care with maximum group sizes as follows: under 1 year = 12; under 18 months/not walking = 12; 1 year and walking = 16; 2 years = 20; 3 years = 30; 4 years = 36; 5 years = 40; and 6 years and older = 50.
During an investigation, it was determined that on July 31, 2025, at approximately 10:30 a.m., one staff member was outside on the playground with 15 2-year-old children while the other staff member was standing in the classroom doorway supervising three 2-year-old children in the bathroom. A 2-year-old child fell from the side of the slide's wall sustaining a left arm injury. The staff member standing in the doorway was not physically present on the playground and therefore could not respond to the needs of the children outside. As a result, only one staff member was actively supervising the 15 2-year-old children on the playground. The required staff-to- child ratio for 2-year-old children is 1:10. A second staff member was needed to meet the minimum ratio.

591-1-1-.03(9) · Rule 591-1-1-.03(9) requires that Staff shall not engage in, or allow children or other adults to engage in, activities that could be detrimental to a child’s health or well-being, such as but not limited to, horse play, rough play, wrestling, and picking up a child in a manner that could cause injury.
During an investigation, it was determined that on July 31, 2025, at approximately 10:30 a.m., a 2-year-old child was standing on a slide's side wall on the playground and fell backwards. The center staff failed to intervene with redirection or physically remove the child from the slide’s side wall, which resulted in the 2- year-old child sustaining a closed fracture of the left arm.
