591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. During an Incident Investigation Closure conducted on October 20, 2023 ; It was determined based on investigative findings a self-reported incident revealed that on September 21, 2023, at 7:36 a.m. watchful oversight was not being provided to a one-year-old child who was in a highchair, when the staff member turned away from the child after removing the tray and didn't realize that the safety straps were not being used. The child fell out of the high chair and sustained scratches and a bruise.

During a Complaint Closure conducted on December 19, 2023 ; It was determined based on investigative findings that, on November 29, 2023, center staff left a five-year-old child unattended on the playground when a child holding the door let the door close before the five-year-old child entered the classroom. The five-year-old child opened the door to enter the classroom.

During a Complaint Closure conducted on August 26, 2024 ; It was determined that two staff did not provided watchful oversight when a child was observed hitting another child on the face, hitting the child on the head, pulling his hair and snatching items from his hands. The child was observed crying as the result of the physical altercation. The two staff were observed in the classroom, however the staff were not alert to promptly intervene on behalf of the child. During a Monitoring Visit conducted on August 10, 2022 ; It was determined based on observation that there were twenty-five (25) children present in classroom A which is licensed for twenty-two (22) children. In addition, there were seventeen (17) children in classroom G which is licensed for thirteen (13).

During a Licensing Study conducted on March 16, 2023 ; It was determined based on observation that the trash cans in classrooms Infant A, Infant B, and classroom N did not have a tight-fitting lid as required.
