    591-1-1-.26(8) · Rule 591-1-1-.26(8) requires climbing and swinging equipment to have a resilient surface beneath the equipment and the fall zone from such equipment must be adequately maintained by the Center to assure continuing resiliency.

    During a Complaint Investigation Follow Up conducted on September 17, 2025 ; It was determined based on observation that the preschool playground under the slides and swings had less than 2 inches of resilient surface when 6 inches were required. Exhibit "A"

    591-1-1-.26(4) · Rule 591-1-1-.26(4) requires that playgrounds be protected from traffic or other hazards by a (4) four foot high fence or other barrier approved by this Department. Fencing material shall not present a hazard to children and shall be maintained so as to prevent children from leaving the playground area by any means other than through an approved access route. Fence gates shall be kept closed except when persons are entering or exiting the area.

    During a Licensing Study conducted on November 5, 2024 ; It was determined based on observation that the gate from the unused playground on the far left to the preschool classroom was not secured. Fencing alongside the preschool and toddler playground was observed to be unsecured at the top railing and not secured on the bottom for approximately 15 inches.

Fence gates shall be kept closed except when persons are entering or exiting the area.

    During a Complaint Investigation Follow Up conducted on September 17, 2025 ; It was determined based on observation that the left gate on the preschool playground was broken and could not be closed properly. The wire fence that separates the preschool and toddler playground contained six holes at the bottom of the fence that measured 3-12 inches each; additionally, the top portion of the fence was not secured to the metal pole and the fence contained exposed sharp metal along the top.
