591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children shall be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.
During an investigation, it was determined that on March 4, 2026, at approximately 4:45 p.m., a 3-year-old child’s hand was wedged in the exterior door when a staff member was not aware that the child was behind them. Staff on the playground opened the exterior door to allow another child to use the restroom inside the classroom. Staff were unaware the child was behind them, and the child’s hand got stuck in the hinge side of the door. Staff were unable to remove the child’s hand, and emergency services were called. The child’s hand was removed by emergency services and professional medical attention was received.

During an incident investigation and follow-up visit conducted on August 15, 2024, it was determined based on staff statements, interviews, and video footage, that on July 1, 2024, staff failed to provide watchful oversight, when a staff member closed a two-year-old child’s finger in the classroom door. The staff member had the door open while throwing out diapers, when the child was behind the staff, and the door was closed on the child’s finger. Professional medical attention was required.

591-1-1-.29(3) · Rule 591-1-1-.29(3) requires that the Director or designated person-in-charge shall report or cause to be reported to the Department within twenty-four (24) hours or the next work day: any death of a child while in the care of the Center; any serious illness or injury requiring hospitalization or professional medical attention other than first aid of a child while in the care of the Center; any situation when a child in care becomes missing, such as, but not limited to, a child who is left on a vehicle, a child who leaves the building, playground, or property, or a child who is left behind on any trip; any fire; any structural disaster; any emergency situation that requires temporarily relocating children; and any time the program’s operating status changes (i.e., open to closed or temporarily closed and temporarily closed to open).
During an incident investigation and follow-up visit conducted on August 15, 2024, it was determined based on review of documents, that the center failed to report an incident requiring professional medical attention to the department within 24 hours as required. A two-year-old child sustained an injury to the finger when the child’s finger was closed in the classroom door, by a staff member. The incident occurred July 1, 2024, and was not reported to the department until July 31, 2024.

During an incident investigation and follow-up visit conducted on June 3, 2024, it was determined based on an investigation that staff failed to provide watchful oversight when a one-year-old child’s leg got stuck between a bye- bye buggy and the wall. The staff failed to check all children and the surroundings when turning the buggy around. The child required professional medical attention.

Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. It was determined based on an investigation that on April 30, 2024, at 5:00 p.m., that a one-year-old child sustained an injury to their right leg while being maneuvered in a buggy by a staff member. The staff member pushed and pulled five children in a forward and reversed direction down the hallways of the center with limited space. The staff member pulled the buggy backwards, where they were not positioned to see the children to prevent harm or injury. The staff member attempted to turn the buggy around, and the child’s right leg was wedged into a wall. As a result of the staff member’s failure to maintain watchful oversight, the child required professional medical attention for a leg injury.
