591-1-1-.03(9) · Rule 591-1-1-.03(9) requires center staff to refrain from engaging in, or allowing children or other adults to engage in, activities that could be detrimental to a child's health or well-being, such as but not limited to, horse play, rough play, wrestling, and picking up a child in a manner that could cause injury.

During an investigation, it was determined that on August 22, 2025, staff failed to physically intervene before a 2- year-old child jumped off a low shelf and hit a chair, resulting in a cut under the child’s eye. As a staff person was putting away mats after naptime when the 2-year-old child climbed on the shelf. The staff person attempted to verbally redirect the child but did not physically intervene. The child jumped off the shelf and hit their face on a child-sized chair. The child sustained a cut underneath the right eye and received professional medical attention to close the cut.
