During an Incident Investigation and Follow Up on February 23, 2026, it was determined based on observation that the staff member in Main Room D-4L-Rear was not seated within an arm’s length away from seven 1-year- old children during mealtime. The staff member was observed standing at a closet located across the classroom from where the children were seated at a table. An adverse action was previously issued for this rule violation. This rule violation is no longer appealable. No fine is being issued at this time. C. The child was lying on top of a wedge-shaped cushion behind the shelf. The child tried to stand up on their left leg, tumbled forward, and struck their face on the shelf. The staff member was not positioned to see the incident and was unable to determine what caused the injury until the video footage was reviewed. The child sustained a cut to their upper lip and received professional medical attention.

During an investigation, it was determined that on January 18, 2023, a four and a five-year-old child were hit on the face by a staff person during story time because they were laughing and not listening. The four-year-old child sustained a mark. Additionally, the staff person forcefully pulled the five-year-old child by the ear. The staff person was terminated. Law enforcement charged the staff person with two counts of Cruelty to Children and was arrested. 2. A. Rule 591-1-1-.31(13) prohibits Center Staff from committing any criminal act, as defined under Georgia law, in the presence of any child enrolled in the Center and requires Center staff to comply with all applicable laws and regulations. During an investigation, it was determined that on January 18, 2023, a teacher committed a criminal act in front of children in care when the teacher slapped a four-year-old child and a five-year-old child during a story time activity. The teacher also forcefully pulled the five-year-old child's ear. A mark was observed on the four-year-old child's face. Law enforcement charged and arrested the staff person for two counts of Cruelty to Children.
