    591-1-1-.03(9) · Rule 591-1-1-.03(9) requires that staff shall not engage in, or allow children or other adults to engage in, activities that could be detrimental to a child’s health or well-being, such as but not limited to, horse play, rough play, wrestling, and picking up a child in a manner that could cause injury.

    During an investigation, it was determined that on March 10, 2026, at approximately 2:56 P.M., staff failed to physically intervene in stopping children from climbing on a shelf and jumping off multiple times, resulting in a 4- year-old child sustaining a left wrist injury. There was one staff member caring for seven three and four-year-old children when the incident occurred. Per video footage, multiple children climbed on and jumped from multiple shelves and tables before the child was injured. The staff member was standing in the center of the room, facing the opposite direction, from the area of where the child was injured. The injury required professional medical attention.

Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.

    During an investigation, it was determined that on March 10, 2026, multiple children were climbing and jumping from a shelf in the classroom when a 4-year-old child sustained an injury to the left wrist. One staff member was supervising one 3-year-old child and six 4-year-old children. Per video footage, the staff member was not faced towards the children during multiple occasions of jumping on and from furniture, children pushing and playing roughly or when a child fell backwards out of a chair with a drumstick in their hand. Staff were unaware the child had fallen and was injured until the injured child made the staff member aware and was holding their arm. The injury required professional medical attention.

    During an investigation, it was determined that on March 10, 2026, a 4-year-old child sustained an injury to the left wrist that required professional medical attention. The center was notified on March 11, 2026, of the medical attention, and failed to report the incident to the department within 24 hours or the next work day as required.

    During an investigation, it was determined that on November 29, 2022, a six-year-old child was dropped off and left at an elementary school before the school was open and no one was available to receive the child. The child was left outside alone for an undetermined amount of time.
