591-1-1-.32(2) · Rule 591-1-1-.32(2) requires the Center maintain Staff:child ratios in mixed-age groups based on the age of the youngest group of children that includes more than twenty percent of the total number of children in the mixed-age group.

During a Monitoring Visit conducted on July 20, 2022 ; It was determined based on observation that a ratio of 1:17 was observed in the Main D-Back classroom. There were 17 children present, which included two two-year-olds, twelve three-year-olds, and three four-year-olds. A ratio of 2:17 was required.

During a POI Follow Up conducted on May 24, 2022 ; It was determined based on observation that a ratio of 1:11 was observed in the Main B-Front classroom when there were four one-year-olds and seven two- year-olds. A ratio of 2:11 would be required.

591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.

During an Incident Investigation Closure conducted on April 25, 2022 ; It was determined that on March 3, 2022, at approximately 12:15 p.m., a three-year-old child exited the playground unsupervised and was found by three strangers approximately 350 feet from the child care center. An adverse action was previously issued for this rule violation. This rule violation is no longer appealable. No fine is being issued at this time.

During a Monitoring Visit conducted on July 20, 2022 ; It was determined based on observation that a child briefly walked out of the Main D-Back classroom without adult supervision for approximately one minute and was brought back to the classroom by the consultant. Staff were not aware that the child had left the classroom and was in the hallway. Exhibit "A"

591-1-1-.29(3) · Rule 591-1-1-.29(3) requires the Director or designated person-in-charge to report or cause to be reported to the Department within 24 hours or the next work day: any death of a child while in care of the Center; any serious illness or injury requiring hospitalization or professional medical attention other than first aid of a child while in the care of the Center; any situation when a child in care becomes missing, such as, but not limited to, a child who is left on a vehicle, a child who leaves the building, playground, or property, or a child who is left behind on any trip; and fire; any structural disaster; and any emergency situation that requires temporarily relocating children.

During an Incident Investigation, it was determined that on March 3, 2022, the Director or designated person-in- charge failed to report to the Department within 24 hours when a three-year-old child exited the center’s playground unsupervised and was found approximately 530 feet from the child care center. The three-year-old child did not sustain injuries and professional medical attention was not obtained.
