591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the childcare area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty- six (36) months of age and younger.
During an investigation, it was determined that on May 28, 2025, at approximately 10:50 a.m., a 5-year-old child sustained a nose injury after being pushed on a scooter by another child. The 5-year-old child landed face forward on the floor. There were two staff members and eighteen school aged summer camp children in the classroom at the time of the incident. One staff member was positioned at the front of the classroom participating in an activity with children. The other staff member was positioned at the back of the classroom working on lesson plans at a counter table. Based on video footage, there were three children riding scooters in the classroom. The scooter rolled backward, which caused the child to fall forward and hit their face on the floor. The 5-year-old child started to cry, holding their nose. The staff member positioned at the back of the classroom went to assist the child. The staff member notified the center management and reported the 5-year-old was injured. Staff failed to actively supervise and provide watchful oversight to the children while at the center, which resulted in the 5-year-old child sustaining a nose injury when participating in an activity involving riding scooters and being pushed by another child. Staff did not see the incident occur. The child received professional medical attention.
