591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.
During an investigation, it was determined that on August 8, 2022, children were not adequately supervised when a one-year-old child sustained multiple bite marks and bruises from another child while on the playground. According to reports, there were two staff persons on the playground who were speaking to a parent who had arrived for pick up. A third staff person walked outside to pick up their own child. According to reports, the third staff person heard screaming coming from a tunnel and observed a child on top of the one-year-old child inside the tunnel. It was reported that the one-year-old child sustained a bite mark on the left leg with broken skin, a bite mark on the left arm, a bite mark on the left cheekbone, and bruises on the back. It was also reported that the child received professional medical treatment.

591-1-1-.36(6) · Rule 591-1-1-.36(6) requires that routine transportation provided by the Center or on behalf of the Center, the child's Parent(s) must provide written authorization for the transportation and specify routine pick-up location, routine pick-up time, routine delivery location, routine delivery time and the name of any person authorized to receive the child.
During an investigation, it was determined that on August 13, 2021 center staff failed to ensure parental authorization when a five-year-old child was dropped off at a location that was not authorized by the child’s parent.

591-1-1-.36(7)(c) · Rule 591-1-1-.36(7)(c) requires that passenger transportation checklist, provided by or in a format approved by the Department, shall be used to account for each child during transportation. A separate passenger checklist shall be used for each vehicle.
During an investigation, it was determined that on August 13, 2021 center staff failed to ensure that a passenger transportation checklist was used when a five-year-old child exited the vehicle at the wrong elementary school and staff were not aware. The staff member did not account for each child that exited the vehicle.

591-1-1-.36(9) · Rule 591-1-1-.36(9) requires that staff is responsible for the child from the time and place the child is picked up until the child is delivered to his or her Parent(s) or the responsible person designated by his or her Parent(s). A child shall not be dropped off at any location if there is no one present authorized to receive the child.
During an investigation, it was determined that on August 13, 2021 center staff failed to assume responsibility of a five-year-old child when the child was dropped off at the wrong elementary school. The staff member responsible for transporting the child was not aware that the child exited the vehicle and the child remained with the elementary school staff until the authorized staff member retrieved the child.

During an investigation, it was determined that on August 13, 2021 center staff failed to account for each child as they exited the vehicle during transportation and that the checklist was erroneously completed to indicate that a check of the vehicle was done. The staff was not alert and aware that the child exited the vehicle. The staff member directed the child to return to their seat but did not verify that the child returned to their seat. The child had exited the vehicle and was not supervised by the staff responsible for care.
