591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.
During an investigation, it was determined that on September 4, 2025, at approximately 3:30 p.m. children were not adequately supervised when a 3-year-old child’s finger was closed in the hinge side of an exterior door. The class was lined up in the classroom at the door leading to the playground. A Staff Person outside on the playground opened the door. When they let go of the door, the door closed with the child’s finger in the hinge side of the door. Staff failed to provide watchful oversight in order to prevent the injury from occurring. The child sustained an injury to their right hand.

During an investigation, it was determined based on an investigation that on September 4, 2025, at approximately 3:30 p.m. a Staff Person did not respond promptly to a 3-year-old child’s distress signal and need for comfort when their finger was closed in the hinge side of an exterior door by a Staff Person on the playground. The child immediately began to scream. The Staff Person took more than a minute after the child’s finger was removed from the hinge side of the door, before responding or comforting the child. The Staff Person looked at the child’s finger and held their hand over their head until management arrived .

During an investigation, it was determined that on July 18, 2024, there were two staff members with children from two separate preschool classes on the playground. The staff members were positioned on the same side of the playground and were not circulating the play area. According to video footage, the four-year-old child jumped from the top of the slide and landed feet first on the ground. The four-year-old child attempted to jump off the slide a second time, however, their feet got caught on the side of the slide, and the child fell from the slide, landing on their back and shoulder as they hit the ground. The staff members did not consistently circulate the playground areas where the children were occupied to ensure that they were actively monitoring all the children. The child was taken to the office to be evaluated, and the child’s parent was contacted. The child was taken for professional medical attention and was treated for a shoulder injury.

591-1-1-.12(1) · Rule 591-1-1-.12(1) requires all indoor and outdoor furniture, activity materials, and equipment shall be used: in a safe and appropriate manner by each Employee and child in attendance; and in accordance with the manufacturer’s instructions, recommendations, and intended use. All equipment and furniture shall be used only by the age-appropriate group of children.
During an investigation, it was determined that on July 18, 2024, a four-year-old child was injured while on the playground. The four-year-old child was not utilizing the outdoor slide climber in an appropriate manner when the child jumped from the top of the slide and sustained a shoulder injury.

591-1-1-.08(6) · Rule 591-1-1-.08(6) requires Arrival and Departure Records. Records of a child’s daily arrival and departure for the twelve (12) preceding months shall be maintained but need not be filed in each child’s record. The Parent or person(s) authorized by the Parent to drop off and pick up the child will document, in written or electronic format, each time the Parent or authorized person drops off and picks up the child. The documentation shall include at least the following information: the date, the child’s name, the arrival and departure times, and the signature or initials of the Parent or authorized person at the time of arrival and departure. These records shall be made available to the Department in printed or written form upon request.
During an investigation, it was determined that on July 18, 2024, the center records revealed that the center failed submit records to the Department that would confirm that the center had maintained documentation of the arrival and departure times for the children that were attending the 3's one and 3's two classrooms on July 18, 2024.

There was one staff member and four children in the infant classroom. Three children played near a rocking chair in a back corner of the classroom. Two children were behind the glider and one child was in front. The staff member was at the front of the classroom posting items on the doors. The children screamed and the staff member, facing the doors, called out to them to stop screaming. The staff then walked to a counter at the front of the room as the children continued to scream. The staff again told the children to stop screaming and to move away from the chair. The two-year-old child walked from behind the rocking chair, crying, with their hand on their bleeding mouth. The staff member observed that the child was injured, and the director was notified. The parent of the child was contacted and advised of the child's injuries. The parent transported the child to a medical facility for treatment. The staff member was not positioned to be able to respond promptly to the needs and actions of the children that were being supervised, resulting in the two-year-old child sustaining a cut on the upper lip which required professional medical attention. Five stitches were required to close the wound.
