591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in- Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm¶s length away from children thirtysix (36) months of age and younger.
During a Complaint Closure conducted on March 28, 2023, it was determined based on investigative findings that on January 30, 2023, children were not adequately supervised when a two-year-old child exited the playground, through an inner gate, unnoticed. One staff person noticed that the playground gate leading to the side of the building was open and the alarm on the exterior gate at the front of the building was sounding. A parent arrived for pick up and observed the two-year-old child outside of the exterior gate. The parent brought the child inside and delivered the child to management. The child was unsupervised for an undetermined length of time.

During a Licensing Study conducted on August 9, 2022, it was determined based on observation that staff members were clearing the tables, changing diapers, and setting out cots when two-year-old children were eating lunch in classroom E-5R.

During a Complaint Investigation and Monitoring Visit conducted on February 14, 2023, it was determined based on observation that center staff were not seated within arm’s reach of children during lunch in classroom B 2R and C3R. Staff members in B2R were walking from the shelf to the tables serving food and the staff member in C 3R was moving between two tables where children were eating.
