    591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.

    During an Incident Investigation and Follow-up visit conducted on February 8, 2023, it was determined based on an investigation that on December 21, 2022, a three-year-old child tripped and fell on the carpet while walking after another child. The teachers did not observe exactly how the child fell, as they were in an area of the classroom where a shelf blocked their view, when the child fell. The child sustained an arm injury and received professional medical attention.

This rule violation is no longer appealable. No fine is being issued at this time.

    During a Monitoring Visit conducted on February 25, 2022 ; It was determined based on observation that the premises were not kept in good repair as the following areas of disrepair were noted: - A hole in the wall measuring over two inches wide was observed behind the classroom door in Room G - A broken toilet paper holder was located in the children's bathroom in Room B - One of two children's toilets was observed to be broken and did not flush in Room A

Professional medical treatment was required when the child began to display signs of unusual behavior. The child was treated for a concussion. An adverse action was previously issued for this rule violation. This rule violation is no longer appealable. No fine is being issued at this time.

    During an investigation, it was determined that on October 22, 2021, there was a lack of watchful oversight when a one-year-old child sustained a head injury and staff reported that they were unaware of what happened but assumed the child fell and hit their head. Two staff members were present in the classroom. Staff reported that one staff member was changing diapers while the other staff member handed out toys to the rest of the class. Neither staff member saw what happened, but when they heard the child crying, they noticed that the child was sitting on the floor as if they had fallen or been pushed. The child continued to cry inconsolably, and staff observed that the child struggled to remain awake, and their pupils appeared larger than usual. Professional medical treatment was required, and the child was treated for a concussion.

    During an investigation, it was determined that on October 22, 2021, center staff failed to report to the Department within 24 hours when a one-year-old child sustained a head injury that required professional medical treatment. The parent informed staff of the child’s diagnosis verbally and through a message on the parent portal, however, staff assumed the injury was an old diagnosis and failed to inquire further. The child was treated for a concussion.
