591-1-1-.26(4) · Rule 591-1-1-.26(4) requires that playgrounds be protected from traffic or other hazards by a (4) four foot high fence or other barrier approved by this Department. Fencing material shall not present a hazard to children and shall be maintained so as to prevent children from leaving the playground area by any means other than through an approved access route. Fence gates shall be kept closed except when persons are entering or exiting the area.
During a Complaint Investigation & Monitoring Visit conducted on September 30, 2025 ; It was determined based on observation and measurement there was a four to eight inch gap at the corner of the wood fence on the right back side of the preschool playground. It was further determined that there was a four to five inch gap between the fence pole and the building on back left side of the center.

591-1-1-.26(6) · Rule 591-1-1-.26(6) requires that playground equipment provide an opportunity for the children to engage in a variety of experiences and shall be age-appropriate. For example, toddlers shall not be permitted to swing in swings designed for School-age Children. The outdoor equipment shall be free of lead-based paint, sharp corners and shall be regularly maintained in such a way as to be free of rust and splinters that could pose significant safety hazard to the children. All equipment shall be arranged so as not to obstruct supervision of children.
During a Complaint Closure conducted on April 22, 2025 ; It was determined based on investigation that on March 25, 2025, the equipment on the infant and toddler playground was not maintained when the metal cars, seesaw, and roundabout cycle had peeling paint.

During a Licensing Study conducted on February 17, 2025 ; It was determined based on observation that the following hazards were observed: B:2R: -There was a staff purse on a shelf near the back of the classroom. -There were several plastic grocery bags on a shelf next to the entrance door. -There was a Swiffer in the children's bathroom. C: Middle: -There was a vacuum next to a shelf in the middle of the classroom. -There was a plunger in the children's bathroom. -There was a toilet bowl brush in the children's bathroom.

During a Complaint Investigation & Monitoring Visit conducted on September 30, 2025 ; It was determined based on observation that the following hazards were observed: Classroom B-2-R - Plastic shopping bags were observed in baskets. - Diaper wipes with warning labels stating keep out of reach of children were in three baskets - A diaper ointment was observed in one basket.

It was further determined that on March 25, 2025, the metal fence facing the center driveway on the infant-toddler playground was not in good repair when three prongs were protruding at the children¶s eye level.

The driver or other designated staff person shall document in writing with a different mark/symbol to account for each child listed on the passenger transportation checklist who was not present on the vehicle for any reason. An explanation shall be documented in writing whenever a child is transported to a field trip site but is not present on the return trip to the Center.
During a Licensing Study conducted on February 17, 2025 ; It was determined based on a review of records that there were no load or unload indicators for children who were transported on the morning route to West Newton Elementary School from the childcare center on February 10, 2025 and February 11, 2025. It was further determined that there were no load or unload indicators for children who were transported on the afternoon route to the center from West Newton Elementary School February 10, 2025 and February 11, 2025. An adverse action was previously issued for this rule violation. This rule violation is no longer appealable. No fine is being issued at this time.
