    591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.

    During an investigation, it was determined that on June 1, 2023, in the two-year-old classroom, center staff were not providing watchful oversight to prevent an incident from occurring when a two-year-old child was running in the classroom, fell and sustained an injury to their head. Staff did not see how the child fell or what the child fell on to cause the injury. Professional medical attention was obtained.

    During an investigation, it was determined that on June 1, 2023 a child was running in a classroom, fell, and sustained a cut on the forehead that required professional medical attention and center staff did not report the incident to the department within twenty-four hours as required.

    During an Incident Investigation Closure conducted on April 27, 2022 ; It was determined based on an investigation that on March 4, 2022, the center failed to ensure climbing equipment and swinging equipment had sufficient resilient surface beneath the equipment and fall zones when the playground structure had less than 3 inches of resilient surface. Six inches was required. A three-year-old child missed a step and fell from the play structure and sustained a broken arm. Professional medical attention was provided. An adverse action was previously issued for this rule violation. This rule violation is no longer appealable. No fine is being issued at this time.

    591-1-1-.26(8) · Rule 591-1-1-.26(8) requires that climbing and swinging equipment shall have a resilient surface beneath the $499.00 equipment and the fall zone from such equipment must be maintained by the Center to assure continuing resiliency.

    During an investigation, it was determined that on March 4, 2022, a three-year-old child fell from a playground structure and sustained a broken arm. While walking down the steps on the playground structure the child was observed to call out to a friend and missed a step resulting in the child falling. Center staff confirmed that the resilient surfacing beneath fall zones at the time of the incident measured three inches underneath a playground structure. Six inches of resilient surfacing was required in the fall zones of the playground structure. Professional medical attention was received.
