591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty-six (36) months of age and younger.
It was determined based on an investigation that on September 15, 2025, at approximately 9:19 a.m., a 2-year-old child sustained an injury to their left eye while in a classroom. Staff members observed scratches and puffiness on the child’s face but were unaware of how the injury occurred. Staff failed to provide watchful supervision in order to prevent the injury from occurring. Professional medical attention was obtained.

591-1-1-.07(2) · Rule 591-1-1-.07(2) requires that Parents be immediately notified and specific instructions obtained until the child can be picked up or returned to the group, immediately when professional medical attention is required, or when the child experiences symptoms of moderate discomfort, or when the child is involved in an incident that puts their health and/or safety at risk and to notify Parents by the end of the day when professional medical attention is not required, when the child experiences symptoms of less than moderate discomfort or when the child experiences an adverse reaction to prescribed medication which does not constitute moderate discomfort.

At approximately 4:45 p.m., the child was found in the restroom by the staff member, an administrator, and the child’s parent. It was determined that the child was left alone in the restroom for approximately 45 minutes.

591-1-1-.29(3) · Rule 591-1-1-.29(3) requires the Director or designated person-in-charge shall report or cause to be reported to the Department within twenty-four (24) hours or the next work day: any death of a child while in the care of the Center; any serious illness or injury requiring hospitalization or professional medical attention other than first aid of a child while in the care of the Center; any situation when a child in care becomes missing, such as, but not limited to, a child who is left on a vehicle, a child who leaves the building, playground, or property, or a child who is left behind on any trip; any fire; any structural disaster; any emergency situation that requires temporarily relocating children; and any time the program’s operating status changes (i.e., open to closed or temporarily closed and temporarily closed to open).
During an investigation, it was determined that the center did not report to the Department within 24 hours or the next work day that on June 30, 2025, a 3-year-old child was left alone in the restroom while the assigned staff member and the remainder of the class were outside on the playground. At approximately 4:00 p.m., the child was in the restroom when the class and the assigned staff member went outside. At approximately 4:10 p.m., the staff member reentered the classroom with another child and left again. At approximately 4:35 p.m., the child began to cry and continued to do so until they were found. At approximately 4:45 p.m., the child was found in the restroom by the staff member, an administrator, and the child’s parent. It was determined that the child was left alone in the restroom for approximately 45 minutes.

591-1-1-.11(2) · Rule 591-1-1-.11(2) requires that Personnel not: physically or sexually abuse a child or engage or permit others to engage in sexually overt conduct in the presence of any child enrolled in the Center; inflict corporal/physical punishment upon a child; shake, jerk, pinch or handle a child roughly; verbally abuse or humiliate a child which includes, but is not limited to, the use of threats, profanity or belittling remarks about a child or his family; isolate a child in a dark room, closet or unsupervised area; use mechanical or physical restraints or devices to discipline children; use medication to discipline or control children's behavior without written medical authorization issued by a licensed professional and given with the parent's written consent; restrict unreasonably a child from going to the bathroom; punish toileting accidents; force-feed a child or withhold feeding a child regularly scheduled meals and/or snacks; force or withhold naps; allow children to discipline or humiliate other children; or confine a child for disciplinary purposes to a swing, highchair, infant carrier, walker or jump seat.
During an investigation, it was determined that on May 7, 2025, and May 9, 2025, center staff inappropriately disciplined a 4-year-old child. On May 7, 2025, and May 9, 2025, a staff member was brought into the classroom to discipline a 4-year-old child for not sleeping during nap time. On May 7, 2025, the staff member used an aggressive tone, and demanded the child lie in a specific position on their cot and threatened to physically move the child to another classroom if the child did not listen. It was further determined that on May 9, 2025, center staff inappropriately disciplined the same 4-year-old child. The staff member grabbed and held the child down during naptime, causing multiple nail marks on both of the child's arms. Video footage revealed that the staff member aggressively picked up the 4-year-old child by their arms from their cot on two separate occasions on May 9, 2025, as a form of discipline when the child would not go to sleep. Additionally, the staff member made threatening and inappropriate statements toward the child intended to compel the child’s compliance.

During an investigation, it was determined that on June 6, 2023, at approximately 9:55 a.m., children were not adequately supervised when a one-year-old child’s finger got stuck in the back of the door, resulting in a finger jam. A staff person was assisting with holding the door open and the additional staff person was assisting with getting the class inside from the playground. At the time of the incident, the one-year-old child walked behind the door and placed their hand in the opening at the back of the door. The staff person noticed that there was something stuck in the door as the one-year-old child screamed when staff attempted to close the door. Several efforts were made by staff to remove the one-year-old child’s hand, however, center staff was not able to remove the child’s hand. The center contacted 911 emergency services, paramedics arrived first and could not remove the child’s hand. The emergency medical technicians were able to release the one-year-old child’s hand from the door by prying the door open with a tool. The child received professional medical treatment.

During an investigation, it was determined that on March 4, 2022, at approximately 3:00 p.m., children were not adequately supervised when a two-year-old child’s finger was closed in the hinge side of a closet door, resulting in a contusion. A staff person went to a closet in the classroom to retrieve a water bottle. As the staff person was stepping out of the closet, they opened the door slowly. The staff person turned around and saw the child with their finger in the hinge side of the door. The child’s finger could not be removed. Management called 911 emergency services. Paramedics arrived first and could not remove the child’s finger and did not have the necessary tools to unhinge the door. At approximately 4:00 p.m., the fire department arrived and quickly removed the door hinge. The child received professional medical treatment and was diagnosed with a contusion.

It was determined that on December 10, 2021, two staff members were observed on video inappropriately handling and yelling at the enrolled children, while in the four-year-old classroom. A four-year-old child sustained bruises on both of their arms as a result of the rough handling. No medical attention was obtained for the injuries.
