    591-1-1-.03(9) · Rule 591-1-1-.03(9) requires center staff to refrain from engaging in, or allowing children or other adults to engage in, activities that could be detrimental to a child's health or well-being, such as but not limited to, horse play, rough play, wrestling, and picking up a child in a manner that could cause injury.

    During an investigation, it was determined that on November 10, 2025, at approximately 4:40 p.m., center staff failed to properly intervene and deter children from using hopper balls in an unsafe manner. During indoor play in the sanctuary, children were allowed to repeatedly jump over and roll over hopper balls. A 3-year-old child fell after rolling over one of the hopper balls and hit their elbow on the floor. The child cried and the parent was notified of the incident approximately 15 minutes later during pickup. The child received professional medical attention and was diagnosed with a fractured elbow.

    591-1-1-.12(1) · Rule 591-1-1-.12(1) requires each Employee and child in attendance to use all indoor and outdoor furniture, activity materials, and equipment in a safe and appropriate manner and in accordance with the manufacturer's instructions, recommendations, and intended use. All equipment and furniture shall be used only by the age-appropriate group of children.

    During an investigation, it was determined that on November 10, 2025, at approximately 4:40 p.m., children were allowed to use hopper balls in a manner that was different from their intended use. During indoor play in the sanctuary, children were allowed to repeatedly jump over and roll over the hopper balls. Staff did not require the children to sit on the hopper balls as the manufacturer intended. A 3-year-old child fell after rolling over one of the hopper balls and hit their elbow on the floor. The child cried and the parent was notified of the incident approximately 15 minutes later during pickup. The child received professional medical attention and was diagnosed with a fractured elbow. 3. Rule 591-1-1-.25(19) prohibits the use of unapproved areas for children's activity. During an investigation, it was determined that on November 10, 2025, the sanctuary was used for indoor play although it was not an approved area for activities. During play in the sanctuary, a 3-year-old child sustained a fractured elbow that required professional medical attention.

    During an investigation, it was determined that on November 10, 2025, a 3-year-old child sustained a fractured elbow while using a hopper ball in an unsafe manner during indoor play in the sanctuary. The child received professional medical attention on November 11, 2025, but the incident was not reported to the Department until November 15, 2025.
