591-1-1-.32(7) · Rule 591-1-1-.32(7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the childcare area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training, and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty- six (36) months of age and younger.
During a complaint investigation, it was determined that on August 26, 2024, at approximately 2:16 p.m. a one- year-old child sustained a gash on the forehead while in the classroom. Staff members were not aware of how the injury happened and could not provide an explanation as to what occurred. However, based on further investigation, including staff interviews and review of available video footage, the following was determined, a one-year-old child was eating while walking around the classroom and was not redirected while in the classroom. The child tripped over a chair leg and hit their forehead on the corner of a table and landed on another child. Staff members did not provide watchful oversight to prevent the incident from occurring. There were two staff members supervising eleven one-year-old children in the classroom at the time of the incident. Staff members A and B indicated that they were gathering sleeping mats when they heard a child cry out. At 2:17 p.m., staff member A explained that they attended to another crying child before they noticed the injured child bleeding. Additionally, it was determined that the staff members were not able to respond promptly to the needs and actions of the child being supervised. The child in question received professional medical attention and sustained a laceration to the left eyelid.

591-1-1-.03(8) · Rule 591-1-1-.03(8) requires that personnel shall provide individual attention to each child. Examples include, but are not limited to: responding promptly to the child’s distress signals and need for comfort; playing with and talking to the children; and providing and assisting the child with personal care in a manner appropriate to the child’s age level, i.e., providing the child privacy in dressing, diapering and toileting functions as the developmental age of the child dictates.
During an investigation, it was determined that on August 26, 2024, staff members failed to provide individual attention to a one-year-old child who sustained a forehead injury in the classroom. According to video footage, the one-year-old child tripped over a chair leg, and hit their forehead on a table corner, the child landed on another child. The staff member A blotted the child’s wound with a tissue, took a photo, and left the child on the floor without offering comfort to the child’s needs. An administrative staff later assessed the child’s injury but did not provide aid or console the child. Another administrative staff person administered first aid to the injured child approximately six minutes after the injury occurred. The Department determined that the center failed to respond promptly to the child’s distress signals and directly to the injured child’s needs.

591-1-1-.29(3) · Rule 591-1-1-.29(3) requires the director or designated person-in-charge shall report or cause to be reported to the Department within twenty-four (24) hours or the next work day: any death of a child while in the care of the Center; any serious illness or injury requiring hospitalization or professional medical attention other than first aid of a child while in the care of the Center; any situation when a child in care becomes missing, such as, but not limited to, a child who is left on a vehicle, a child who leaves the building, playground, or property, or a child who is left behind on any trip; any fire; any structural disaster; any emergency situation that requires temporarily relocating children; and any time the program’s operating status changes (i.e., open to closed or temporarily closed and temporarily closed to open).
During an investigation, it was determined that on August 26, 2024, a one-year-old child was injured while in care. A one-year-old child sustained a laceration to the left eyelid while in care at the center. Center staff failed to submit a required report to the Department within 24 hours or the next workday as required after becoming aware that the one-year-old child had obtained professional medical attention.
