During a POI Follow Up conducted on December 20, 2022 ; It was determined based on observation that the large climbing equipment on Playground B had two inches of resilient surface when six inches was required. It was further determined that the large climbing equipment on Playground C had no resilient surface when six inches was required. An adverse action was previously issued for this rule violation. This rule violation is no longer appealable. No fine is being issued at this time.

Fencing material shall not present a hazard to children and shall be maintained so as to prevent children from leaving the playground area by any means other than through an approved access route. Fence gates shall be kept closed except when persons are entering or exiting the area.
During an Incident Investigation/Monitoring Visit conducted on September 14, 2022 ; It was determined based on observation that there was a gap in the fencing on the back right side that measured over four inches in width that could cause an entrapment hazard. An adverse action was previously issued for this rule violation. This rule violation is no longer appealable. No fine is being issued at this time.

It was further determined that at the middle of the left fence on Playground C there was a four inch gap that measured seven inches wide at the bottom of the fence.

During an Incident Investigation & Follow Up conducted on May 26, 2022 ; It was determined based on observation that a ratio of 1:9 was observed in the one-year-old room during nap time when 2:9 was required.

During a Licensing Study conducted on April 1, 2022 ; It was determined based on observation that the left side fence on Playground B had two openings one measured at two feet, three inches wide and nine inches length from top to bottom, which could pose a hazard to the children. The other opening at the back left fence under the wooden barrier measured at four feet wide, which could pose a hazard to the children. It was further determined based on observation that the back left fence on Playground B was bent at the top and did not have a fence pole, which could pose a hazard to the children. It was even further determined based on observation that the front right gate on Playground C was open and was not safely locked to prevent the children from leaving the playground.

During an investigation, it was determined that on May 18, 2021, a six-year-old child climbed a fence to retrieve a ball from an adjoining playground area. Staff statements and interviews were consistent and revealed that the six-year-old child climbed a fence that separated one playground area from another playground area. The child became caught at the top of the fence. The sole staff member on the playground area had to recover the child from the fence. The child’s injuries required professional medical attention.

During an investigation, it was determined that on May 18, 2021, a six-year-old child climbed a fence to retrieve a ball from an adjoining playground area. Photographs revealed that the top portion of the fence had exposed wires and posed a protrusion hazard. The child’s injuries required professional medical attention. 3. Rule 591-1-1-.32 (7) requires that children be supervised at all times appropriate to the individual age, needs and capabilities of each child. Such supervision must include, but not be limited to, indoor and outdoor activities, mealtimes, naptime, transportation, field trips, and transitions between activities. "Supervision" means that the appropriate number of Staff members are physically present in the area where children are being cared for and are providing watchful oversight to the children, volunteers and Students-in-Training. The persons supervising in the child care area must be alert, positioned to maximize their ability to hear and see the children at all times, and able to respond promptly to the needs and actions of the children being supervised, as well as the actions of the volunteers and Students-in-Training and provide timely attention to the children's actions and needs. Staff shall be attentive and participating with all children during mealtimes and shall be seated within an arm’s length away from children thirty- six (36) months of age and younger. During an investigation, it was determined that on May 18, 2021, a six-year-old child was not supervised adequately by center staff to prevent the child from climbing over a fence that divided two playgrounds. When the child attempted to climb back over the fence to return to the assigned playground the child was caught on sharp wiring at the top of the fence and sustained an injury that required professional medical treatment.
